3. The legal description of the structure:

The natural stream channel from the confluence with
Sacramento Creek in section 29, T. 9 S, R, 77 W., 6th P.M.
as the upstream terminus and the confluence with the South
Fork of the South Platte at latitude 3~ deg. 00' 39"N; lon-
gitude 105 deg.44'23"W as the downstream terminus, being 9
distance of approximately 28.8 miles. The downstream ~
terminus is located in an unserveyed area but appears to be
in section 14, T. 12 S., R. 75 W., 6th P.M. This segment
can be located on the Fairplay West, Garo, Hartsel, Sulphur
Ntn., U.S.G.S. quadrangle.

5. The date of appropriation:
January 30, 1980.

6. The amount of vater:

16.0 cubic feet per second of time, May 1 through September
30; and 8.0 cubic feet per second of time, October 1 to
April 30.

7. The use of the water:

Applicant has appropriated water to insure a minimum straam
level to pre~erv~ the natural environment to a reasonable
degree. This appropriation is made pursuant to C.R.S.
1973, 37-92-102(3) and 37-92-103(3), (4), and (10). Water
was first applied to beneficial use on January 30, 1980.
No diversion of the water right herein will be made from
the natural stream channel.
