7. This appropriation is made pursuant to C.R.S.
1973. 37-92-102(3) and 37-92-103(3) and (4). The purpose
of this appropriation by the State of Colorado is to insure
the preservation of a minimum stream level to protect the
natural environment to a reasonable degree.

8. The applicant, oy stipulation, does not ~cknowl-
edge at this time any rights to water by the United States
of America, but in the future if the United States of America
shall seek appropriate judicial determination of any claimed
water rights in the watershed involved herein, the applicant
stipulates and agrees that its right shall be subject to
any adjudicated senior right of the United States of America.

9. The priority herein awarded said Beaver Creek
was filed in the water court in the year of 1978 and shall
be administered as having been filed in that y~ar: ~hd ~h~11..

between all rights, filed in the same calendar year, prior-
ities shall be determined by historical dates of appropria-
