The legal description of the stream segment through <br />which an instream flow is claimed: <br /> <br />The natural stream channel from the headwaters at the <br />spring located at lat. 37029'11"N and long. 106048'11"W as <br />the upstream terminus and extending to the confluence with <br />Pass Creek at lat. 37029'23"N and long. 106045'46"W as the <br />downstream terminus, being a distance of approximately 3.6 <br />miles. This segment can be located on the Wolf Creek Pass <br />U.S.G.S. quadrangle(s). <br /> <br />The stream segment for which an instream flow is requested <br />in this application is not entirely located within an area which <br />has been officially surveyed by the United States government. <br />Thus, the legal description of the location of the instream flow <br />termini incorporates references to longitude and latitude. <br /> <br />8. The source of water: <br /> <br />West Fork Pass Creek <br /> <br />9. The date of appropriation: <br /> <br />May 11, 1989. <br /> <br />10. The amount of water claimed: <br /> <br />1.0 c.f.s. ABSOLUTE (May 1 through September 30); 0.5 <br />c.f.s. ABSOLUTE (October 1 through April 30). <br /> <br />11. The use of the water: <br /> <br />To maintain such minimum flows as are required to preserve <br />the natural environment to a reasonable degree pursuant to <br />sections 37-92-102 and 103, C.R.S. (1990). No diversion of <br />the water right herein will be made from the natural stream <br />channel. <br /> <br />12.
