FINDINGS OF FACT, CONCLUSIONS OF LAW, JUDGMENT AND DECREE

IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE
COLORADO WATER CONSERVATION BOARD ON BEHALF OF THE PEOPLE
OF THE STATE OF COLORADO

IN WEST FORK PASS CREEK, A NATURAL STREAM
IN THE WATERSHED OF THE RIO GRANDE RIVER
IN MINERAL COUNTY

THIS MATTER having come before the court on the application
of the Colorado Water Conservation Board (the "CWCB") and the
court being fully advised as to the matter of the application
herein, hereby enters the following Findings of Fact, Conclusions
of Law, Judgment and Decree.

FINDINGS OF FACT

1989.

1. The above-captioned application was filed on May 31,

2. A statement of opposition was timely filed by the
Leavell-McCombs Joint Venture ("LMJV").

3. A motion to rerefer was filed on April 3, 1991 and
granted by order of April 12, 1991.

4. The CWCB and the LMJV executed a stipulated agreement
on December 4, 1990 and November 2, 1990, respectively. The CWCB
and the LMJV signed an amended stipulation on si,o {"I/ and
--2I..s..J '11 , respectively, that supersedes the terms of the
or~g~nal stipulation in their entirety.
