<br />Glenmoor Country Club, Inc. <br />Case No, 95 CW 198A <br />Page 7 <br /> <br />(4) To the extent that Glenmoor passes its irrigation return flows through <br />the Glenmoor Ponds, Glenmoor may take credit for such return flows in calculating the stream <br />depletion resulting from the use of water for itrigation of the Country Club property. <br /> <br />(5) Return flows ro:sulting from Glenmoor's use ,of Reusable Return <br />Flows and other reusable water provided under the Denver lease may be, used as a source of <br />replacement for Glenmoor's out-of-priority do:pletions of non-reusable water supplies. <br /> <br />(6) To the extent that Glenmoor diverts its non-reusable return flows for <br />reuse for irrigation of the Country Club Propo:rty, Glenmoor shall replace the depletions resulting <br />from such reuse in accordance with this plan for augmentation. <br /> <br />9. Appropriative Rights of Substitution and Exchange: <br /> <br />A. Glenmoor has made an appropriation of conditional rights of substitution and <br />exchange with dates of appropriation as of September 21, 1994. These appropriations were initiated <br />____ _by Jhe f.Qrm.~i()n of an intent to ~I'I'roJlriate, the identification of the sources of water to be leased <br />from Denver for exchange and substitution pillposes, alienEe compTetion'of a sUDstantialstep in <br />furtherance of the exchanges, <br /> <br />B. All of the exchanges will occur when in priority at a maximum rate of <br />diversion of 10 c.f.s. not to exceed 60 acre-fo:et per month and 150 acre-feet during any calendar <br />year, unless the Denver Lease is amended and a subsequent application is filed with and approved <br />by the Water Court. <br /> <br />C. Glenmoor has approptiated rights of substitution and exchange fmm the <br />following points of delivery of water under the Denver Lease: <br /> <br />(I) Reusable irrigation return flows in Little Dry Creek as measured at the <br />confluence of Little Dry Creek and Greenwood Gulch in an amount as determined by available flow <br />from the Denver Water Board's Daily Operation Sheets; and <br /> <br />(2) Raw water delivered through the outlet of Chatfield Reservoir as <br />measured by'ihe outflow gauge. <br /> <br />7 <br />
