I, COLORADO <br /> <br />JUDGMENT AND DECREE OF THE WATER COURT <br /> <br />CONCERNING THE APPLICATION FOR WATER RIGHTS OF THE GLENMOOR COUNTRY <br />CLUB, INC., IN ARAPAHOE, ADAMS AND DOUGLAS COUNTIES <br /> <br />TIllS MATTER has come before the Water Judge on an Application for Approval of Plan <br />for Augmentation, Including Appropriative Rights of Substitution and Exchange (the "Application") <br />filed by the Applicant, Glenmoor Country Club, Inc., and the Court having reviewed the Application <br />and the other pleadings in this case, having considered the Division Engineer's January 3, 1996 <br />Summary of Consultation in accordance with ~37-92-302(4), IS C.R.S. (1990), and now being fully <br />advised with respect to this matter, enters the following Judgment and Decree with respect to those <br />portions of the Application that do not involve the use of reusable municipal effluent: <br /> <br />1. FINDINGS OF FACT AND CONCLUSIONS OF LAW <br /> <br />, ' <br />I. A properly verified Application was filed in this matter by GIenmoor Country Club, <br />Inc. ("Applicant") on September 29, 1995. Timely and adequate notice of the Application was given <br />in the manner provided by statute. See ~37-92-302, 15 C.R.S. (1990). All notices required by law <br />of the filing of the Application have been given, and the Court has jurisdiction over the Application. <br />The portions of the Application that,do not involve reusable municipal effluent, which are at issue <br />in this Case No. 95CW198A, were re-referred to the Water Judge on February 27, 1997, in <br />accordance with 937-92-303(2), IS C.R.S. (1990). <br /> <br />2. The name and address of the Applicant are: Glenmoor Country Club, Inc., 110 <br />Glenmoor Drive, Cherry Hills Village, CO 80 II O. <br /> <br />3. Timely statements opposition were filed by the Greenwood Metropolitan District, <br />City of Englewood; City of Thomton, City of Aurora, City and County of Denver Board of Water <br />Commissioners, Colorado Water Conservation Board, and City of Greenwood Village. The Cherry <br />Hills Country Club was granted leave to intervene as an opposer. No other statements of opposition <br />have been file\!, and the time for filing such statements has expired. <br /> <br />Exhibit A <br />
