<br />. <br /> <br />. <br /> <br />Legal description of the stream segment through <br />which an Instream Flow is claimed: The natural <br />stream channel from the headgate of the Longmont <br />Diversion in the SE/4 NW/4 sec. 19 T3N R70W <br />6th P.M. as the upstream terminus and extending <br />to the confluence with North St. Vrain Creek in <br />the SE/4 SE/4 sec. 18 T3N R70W 6th P.M. as the <br />downstream terminus being a distance of <br />approximately 0.7 miles. This segment can be <br />located on the Lyons U.S.G.S. quadrangle(s). <br /> <br />c. Use of the water: For Instream Flows to <br />preserve the natural environment to a reasonable <br />degree. <br /> <br />d. Date of appropriation: December 11, 1987. The <br />appropriation was initiated and water first put to a <br />beneficial use on December 11, 1987, by action of the <br />Colorado Water Conservation Board under sections 37-92- <br />102(3), 37-92-103(3), 37-92-104(4), and 37-92-103(10), <br />15 C.R.S. (1990). <br /> <br />e. Amount of-water appropriated: 20 c.f.s ABSOLUTE <br />(April 1 through September 30); 12 c.f.s. ABSOLUTE <br />(October 1 through November 30); and 4 c.f.s. <br />ABSOLUTE (December 1 through March 31). <br /> <br />CONCLUSIONS OF LAW <br /> <br />5. Jurisdiction: The Court has jurisdiction over this <br />proceeding. The Applicant has complied with the required <br />statutory requirements, full and adequate notice of the <br />Applicant's claims have been given in the manner required by law <br />and no additional notice needs to be given. The Court has <br />jurisdiction over the subject matter and over all persons with <br />standing to become parties in this case, whether they appeared or <br />not. <br /> <br />6. Incorporation of Findings of Fact: <br />findings of fact are incorporated herein to <br />constitute conclusions of law. <br /> <br />The foregoing <br />the extent that they <br /> <br />7. No injurious Effect: This Court has considered the <br />Applicant's request for approval of its appropriation of the <br />Instream Flow right more fully described in paragraph 4 above, <br />and concluded as a matter of law that the entry of this Decree <br />approving this Instream Flow right will not injuriously affect <br />the owner of or persons entitled to use water under a vested <br />water right. <br /> <br />3 <br />
