<br />! <br /> <br />. <br /> <br />. <br /> <br />b. A statement of opposition was filed by the City of <br />Longmont ("Longmont"). No other statements of <br />opposition have been filed and the time for filing <br />such statements has now expired. <br /> <br />c. The Division Engineer filed a Summary of <br />Consultation on March 31, 1988 recommending that <br />approval be granted for the Application. <br /> <br />d. This matter was initially referred to the Water <br />Referee for Water Division 1 for consideration <br />pursuant to!i 37-92-203(7),15 C.R.S. (1990). On <br />September 14, 1993, by Order of the Referee entered <br />pursuant to !i 37-92-303(2), 15 C.R.S. (1990), the <br />Application was re-referred to the Water Judge for <br />Water Division 1. <br /> <br />e. CWCB and Longmont have entered into a stipulation <br />dated April 6, 1995, the terms of which are <br />incorporated herein by reference, including the <br />following: <br /> <br />The appropriation date claimed by the CWCB <br />herein is December 11, 1987; the City of <br />Longmont and the Highland Ditch Company have <br />claimed more senior appropriation dates in the <br />cases described below. The CWCB agrees to the <br />administration of the Instream Flow rights decreed <br />herein as junior in priority to, and agrees that <br />it cannot exercise a call to the extent it would <br />curtail, the City of Longmont's water rights <br />decreed, or to be decreed, in Case Nos. 86CW395, <br />87CW212, 87CW213, 87CW214, 87CW215, 87CW216, <br />87CW218, 87CW219, 87CW220, 87CW221, 87CW222, <br />87CW231, 87CW232, 87CW233, 87CW234 and 87CW235, <br />and the Highland Ditch Company's water rights to <br />be decreed in Case No. 87CW253. The CWCB has not <br />filed or has previously withdrawn statements of <br />opposition, shall not move to intervene in and <br />shall not otherwise oppose the entry of decrees in <br />these cases in accordance with the terms of the <br />Applications as they exist on the date this <br />Stipulation is executed. <br /> <br />4. Requested Water Right: The CWCB appropriated the <br />Instream Flow more fully described as follows: <br /> <br />a. The source of the water is South st. Vrain Creek, <br />tributary to st. Vrain Creek. <br /> <br />b. Location: <br /> <br />2 <br />
