FINDING OF FACT.

The CEBOLLA CREEK is a natural stream, tributary to the
Gunnison River in Hins,dale County and in old Water District
No. 62.

Legal description of beginning and end points of minimum.
stream flow claimed: The natural stream channel from conf
E&W Forks Cebolla Creek lat 37058'01" north long 107009'58"
west as the upstream terminus and confl Brush Creek lat 38001'41"
north long 107008 I 53" west as the downstream terminus,. being a
distance of approximately 4.8 miles. This segment .can be located
on the Bristol Head 15', Mineral Mtn:, Cannibal Plateau U.S.G.S.
quadrangle.

Date of initiation of appropriation: September 9, 1980,
by final approval of the Colorado Water Conservation Board at
its general meeting.

Amount of water cla1med: (S - May I through September 30;
W - Oc tctJer 1 through April 30)

A. (Stream only) Flow in C.F.S.: 4 cfs.

This appropriation is made pursuant to the provisions of
C.R.S. 1973, 37-92-102(3) and 37-92-103(3)(4) and (10) known.
as Senate bill 97. The purpose ofth1s appropr1ation by the state
of Colorado is"to"insure the preservation of a minimum stream level
to protect the natural environment to a reasonable degree.

R U L I N G

IT IS THE RULING OF THE REFEREE that no adverse effect can
be determined and that CEBOLLA CREEK, as above descr1bed, is
APPROVED AND GRANTED AND ABSOLUTE IN PLACE DECREE in the amount
of 4.0 c.f.s. of water when and if it is available in the natural
flow, for the purposes of protecting the natural environment
thereof. As of the date of appropriation, September 9, 1980.
