Willi.ull MdJoll.dd <br />Dircclor <br /> <br />May 14, 1981 <br /> <br />TO: Danny Merriman <br /> <br />FROM: Patricia Bernhardt <br /> <br />RE: Referee's Rulings <br /> <br />As you requested, I have checked the Referee's Rulings in <br />Division 4 dated 4-17-81 for cases 80CW381 and 383 through <br />391, inclusive. 'These are rulings for minimum stream flow <br />appropriations in the Cebolla Creek drainage, tributary to <br />the Gunnison River in former water district 62. No errors <br />were found. However, I wonder why a ruling was not issued <br />for case #80CW382 on Cebolla Creek(#2). <br /> <br />I have also reviewed the rulings for cases W-1689 <br />through 95 in Division 7. These are all applications by the <br />Florida Water Conservancy District to change the direct flow <br />rights of 7 ditches to storage rights in Lemon Reservoir, <br />tributary to Florida River. These applications were filed <br />in 1977, and Dave RObbins, our attorney, objected to them at <br />the time as we were intending to file~ minimum stream <br />flow rights pending the completion of litigation concerning <br />the constitutionality of S.B. 97. A stipulation was reached <br />between the Florida Water Conservancy District and the <br />Colorado Water Conservation Board limiting the future con- <br />sumptive use to the historic consumptive use and so avoid <br />injury to our proposed 1977 minimum stream flow applications. <br /> <br />PB/jw <br /> <br />../ <br />
