a. Legal description of the stream segment through which an instream flow is
claimed: The natural stream channel from the confluence offue North Fork and South Fork of
Fooses Creek at latitude 380 31 '27"N and longitude 1060 16' 17"W as the upstream terminus
and extending to the inlet of Fooses Lake at latitude 380 32'24'N and longitude 106014' 54"W
as the downstreanl terminus, being a distance of approxirn.ate1y 1.7 miles. This segment can be
located on the Garfield and Maysville U.S.G.S. quadrangles.

b. Administration: For the stream segments in an unsurveyed area, the Division
Engineer has determined for administrative purposes that the approximate legal description of
the instream flow termini as protracted frorn U.S.G.s. and/or U.S.F.S. mapping is as follows:
upstream temllnus in the NE SE, See, 2, T49S, R6E, N.M.P.M., at a point 1400 feet from the
South section line and 1300 feet from the East section line; downstream terminus in the NE SE,
Sec. 36, T50S, R6E, N.M.P.M., at a point 1800 feet from the South section line and 100 feet
from the East section line.

5. Use of the water:

Instream flow to preserve the natural environment to a reasonable degree.
