The legal description of the structure(s): <br /> <br />The natural stream channel from the confluence with Joe <br />Wright Creek at lat. 40038'12"N, long. 105048'23"W as the upstream <br />terminus and extending to the confluence with Sheep Creek at lat. <br />40041'24"N, long. 105045'42"W as the downstream terminus being a <br />distance of approximately 5.5 miles. Th~s segment can be located on the <br />Boston Peak U.S.G.S. quadrangle(s). <br /> <br />For administrative purposes only, the Division Engineer has <br />translated these legal decriptions of the stream termini into <br />approximate protracted section, township, and range locations from <br />U.S.G.S. mapping as follows: Upstream terminus in the NEl/4, Section <br />32, Township 8 North, Range 75 West, 6th P.M.; downstream terminus in <br />the SWl/4, Section 1, Township 8 North, Range 75 West, 6th P.M. <br /> <br />4. The source of water: Cache La poudre River. <br /> <br />5. The date of appropriation: November 8, 1985. <br /> <br />6. The amount of water: 20 cubic feet per second absolute. <br /> <br />7. The use of the water: <br /> <br />To maintain such minimum flows as are required to preserve <br />the natural environment to a reasonable degree pursuant to sections <br />37-92-102 and 103, C.R.S. (1973 & 1986 Supp.). No diversion of the <br />water right herein will be made from the natural stream channel. <br /> <br />8. The applicant shall install and maintain such measuring <br />devices and maintain such records as the Division Engineer may require <br />for administration of this right. <br /> <br />9. Applicant's decree for a 20 cubic feet per second instream <br />flow on the Cache La poudre River between that River's confluences with <br />Joe wright Creek and with Sheep Creek is junior to the Objector's decree <br />for Trap Lake II, Case No. 82CW289, Water Division No.1, and shall not <br />be construed to require releases of inflows from Trap Lake II, as <br />decreed, in excess of the amount required to be released therefrom by <br />virtue of Applicant's decree in Case No. W-9255-78, Water Division No.1. <br /> <br />10. The priority herein awarded said cache La poudre River <br />(instream flow) was filed in the Water Court in the year of 1985 and <br />shall be administered as having been filed in that year; and shall be <br />junior to all priorities filed in previous years. As between all <br />rights, filed in the same calendar year, priorities shall be determined <br />by historical dates of appropriation and not affected by the date of <br />entry of rUling. <br />
