3. The legal description of the structure(s):

The natural stream channel from the confluence with Joe
Wright Creek at lat. 40038'12"N, long. 105048'23"W as the upstream
terminus and extending to the confluence with Sheep Creek at lat.
40041'24"N, long. 105045'42"W as the downstream terminus being a
distance of approximately 5.5 miles. Th~s segment can be located on the
Boston Peak U.S.G.S. quadrangle(s).

For administrative purposes only, the Division Engineer has
translated these legal decriptions of the stream termini into
approximate protracted section, township, and range locations from
U.S.G.S. mapping as follows: Upstream terminus in the NEl/4, Section
32, Township 8 North, Range 75 West, 6th P.M.; downstream terminus in
the SWl/4, Section 1, Township 8 North, Range 75 West, 6th P.M.

4. The source of water: Cache La poudre River.

5. The date of appropriation: November 8, 1985.

6. The amount of water: 20 cubic feet per second absolute.

7. The use of the water:

To maintain such minimum flows as are required to preserve
the natural environment to a reasonable degree pursuant to sections
37-92-102 and 103, C.R.S. (1973 & 1986 Supp.). No diversion of the
water right herein will be made from the natural stream channel.

8. The applicant shall install and maintain such measuring
devices and maintain such records as the Division Engineer may require
for administration of this right.

9. Applicant's decree for a 20 cubic feet per second instream
flow on the Cache La poudre River between that River's confluences with
Joe wright Creek and with Sheep Creek is junior to the Objector's decree
for Trap Lake II, Case No. 82CW289, Water Division No.1, and shall not
be construed to require releases of inflows from Trap Lake II, as
decreed, in excess of the amount required to be released therefrom by
virtue of Applicant's decree in Case No. W-9255-78, Water Division No.1.

10. The priority herein awarded said cache La poudre River
(instream flow) was filed in the Water Court in the year of 1985 and
shall be administered as having been filed in that year; and shall be
junior to all priorities filed in previous years. As between all
rights, filed in the same calendar year, priorities shall be determined
by historical dates of appropriation and not affected by the date of
entry of rUling.
