ply to the Objectors' rights to sell their lands and/or
water rights unless the Sale involves a change of water
rights Application filed with the Water Court.

To resolve the Objectors' concerns with'the Application
filed in this case, the parties have agreed that in the event the
CWCB acquires water rights which are senior in priority to the
water rights owned by the Objectors at that time and which are
located in the in stream flow r~ached described in the Application
filed in this case, the CWCB w~uld be required under the current
statutes to file an application to change the use of the acquired
water rights with the Water CO~rt_ Once a change of use Applica-
tion is filed with the Water C0urt, the current provisions of
~37-92-302(1) (b) would allow the Objectors to file statements
of opposition to any proposed ~hange which the Objectors believe
may injure their water rights.

The Referee has made such investigations as are necessary
to determine whether or not the statements in the Application are
true and has become fully advi~ed with respect to the subject
matter of the Application. The Referee has spoken to the remain-
ing Objector, Ted Myers, concerning Mr. Myers' objection to this
Application. The Referee has requested that Mr. Myers submit his
concerns that members of the PUblic not gain a right to trespass
on his property to gain access to the instream flow in writing to
the Referee. Mr. Myers has failed to comply with the Referee's
request.
