<br />Pursuant to Order of Referral filed and entered in
<br />
<br />the above case on May 17, 1976, the undersigned Water Referee,
<br />
<br />having investigated the matter of the Application on file
<br />
<br />herein, hereby makes the following findings and ruling thereon:
<br />
<br />FINDINGS OF FACT
<br />
<br />1. That the said Application l1as filed on May 17, 1976.
<br />2. That the Water Clerk caused publication of such filing
<br />as provided by statute; that the time for filing Statements of
<br />Opposition expired on the last day of July, 1976, and that one
<br />such statement was filed on July 6, 1976, by Beaver Park Water
<br />
<br />Users of Penrose, Colorado, who were succeeded by Beaver Park
<br />
<br />Water, Inc.
<br />
<br />3. That the said Application concerns a claim for a
<br />
<br />surface water right having to do with Middle Beaver Creek, a
<br />
<br />~ributary of the Arkansas River located in Teller County,
<br />
<br />Colorado, and to be used for maintenance of SUO? minimum
<br />flows therein as are required" to preserve the natural environ-
<br />
<br />ment to a reasonable degree.
