Statements of Opposition: A Statement of Opposition <br />was filed by the City & County of Denver, acting by and <br />through its Board of Water Commissioners ("Denver"); and <br />by the City of Englewood. No other Statements of <br />Opposition have been filed and the time for filing such <br />statements has now expired. <br /> <br />c. Summary of Consultation: On April 19, 1991, the <br />Division Engineer for Water Division No. 5 submitted a <br />Summary of Consultation stating that the Application <br />appears to be adequate and recommending that the <br />Application should be issued by the Referee as a ruling. <br />The Referee has given this recommendation due <br />consideration. <br /> <br />d. Resolution of Statements of Opposition: All parties <br />filing Statements of Opposition have either reached <br />Stipulations with CWCB, withdrawn their Statement of <br />Opposition, or otherwise approved the terms contained <br />herein. <br /> <br />3. Requested Water RiGht: The CWCB appropriated the <br />Instream Flow more fully described as follows: <br /> <br />a. Source: The source of the water is Hamilton Creek. <br /> <br />b. Location: <br /> <br />Legal description of the stream segment through which an <br />instream flow is claimed: The natural stream channel <br />from the headwaters in the vicinity of latitude 40000' 35" <br />North and longitude 105042' 24" West as the upstream <br />terminus and extending to the diversion structure at <br />latitude 39059'50" North and longitude 105044'40" West as <br />the downstream terminus, being a distance of <br />approximately 2.7 miles. This segment can be located on <br />the East Portal and Monarch Lake U.S.G.S. quadrangles. <br /> <br />Administration: For the stream segments in an unsurveyed <br />area, the Division Engineer has determined for <br />administrative purposes that the approximate legal <br />description for the instream flow termini as protracted <br />from U. S. G. S. mapping is as follows: upstream terminus in <br />the NW/4 NW/4 S32 T1N R74W 6PM; downstream terminus in <br />the NW/4 NE/4 S2 T1S R75W 6PM. <br /> <br />c. Amount of water appropriated: 3.0 c.f.s. ABSOLUTE <br />(May 15 - August 14); 0.35 c.f.s. ABSOLUTE (August 15 - <br />May 14) . <br />
