<br />DISTRICT COURT, WATER DIVISION 5, COLORADO <br /> <br />Case No. 90CW282 <br /> <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, RULING AND DECREE <br /> <br />IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE <br />COLORADO WATER CONSERVATION BOARD ON BEHALF OF THE <br />PEOPLE OF THE STATE OF COLORADO, <br /> <br />IN HAMILTON CREEK, A NATURAL STREAM, <br /> <br />IN THE WATERSHED OF THE COLORADO RIVER <br /> <br />IN GRAND COUNTY, COLORADO. <br /> <br />This matter comes before the Referee on the Application for <br />Water Rights of the Colorado Water Conservation Board (CWCB) to <br />grant its Application for an instream flow water right in Hamilton <br />Creek. <br /> <br />The Referee has reviewed the Application, has reviewed all <br />other pleadings in the file, has made such investigations as are <br />necessary to determine whether the statements in the Application <br />are true, and as a result is fully advised in the premises, and <br />does hereby enter the following Ruling: <br /> <br />FINDINGS OF FACT <br /> <br />1. Notice and Jurisdiction: The CWCB filed the above <br />entitled Application with the Court on December 28, 1990. <br />The case was referred to the Water Referee for Water <br />Division No. 5 in accordance with the provisions of <br />C.R.S. !!l 37-92-101, et seq. (1990 Repl. Vol. 15). <br /> <br />Timely and adequate notice of this proceeding has been <br />gi ven in the manner required by law.
