Diligence <br />applications on storage rights within the instream flow segment <br />decreed prior to June 30, 1990 shall not be considered injurious <br />to the donated water right. <br /> <br />(4. The sale or lease of water stored in the Aspinall <br />Unit, the release of water for the generation of hydropower at <br />that Unit or for compact delivery purposes, or any other opera- <br />tion of the Unit currently authorized by federal law and by the <br />decreed water rights for the Unit shall not be considered injuri- <br />ous to the donated water right. Nothing in this decree shall <br />preclude any party to this decree from asserting any and all <br />other rights or interests which it may have regarding such a sale <br />or lease, release of water, or other operation. <br /> <br />. <br /> <br />~ <br />'J <br />'.l <br /> <br />F. The donated water right shall only be entitled to the <br />first 300 c.f.s., or lesser amount approved for change to in- <br />stream purposes, available at USGS Gauge No. 09128000, and shall <br />not be entitled to call any junior water right if the total <br />available flows at that point equal or exceed 300 c.f.s. Total <br />available flows shall include but are not limited to all flows <br />made available by hydropower or other operations at the Aspinall <br />Unit of the Colorado River Storage Project, or which are lawfully <br />stored and lawfully released from storage at the Aspinall Unit <br />pursuant to a water supply contract or lease of storage water for <br />delivery below USGS Gauge No. 09128000 and through the instream <br />flow segment for any purposes. <br /> <br />G. The following terms and conditions lower the amount of <br />the donated right that can be called for instream purposes when <br />the Aspinall Unit storage levels fall below certain target <br />storage levels: <br /> <br />(1.
