Diligence applications on storage rights within the instream flow segment decreed prior to June 30, 1990 shall not be considered injurious to the donated water right. (4. The sale or lease of water stored in the Aspinall Unit, the release of water for the generation of hydropower at that Unit or for compact delivery purposes, or any other opera- tion of the Unit currently authorized by federal law and by the decreed water rights for the Unit shall not be considered injuri- ous to the donated water right. Nothing in this decree shall preclude any party to this decree from asserting any and all other rights or interests which it may have regarding such a sale or lease, release of water, or other operation. . ~ 'J '.l F. The donated water right shall only be entitled to the first 300 c.f.s., or lesser amount approved for change to in- stream purposes, available at USGS Gauge No. 09128000, and shall not be entitled to call any junior water right if the total available flows at that point equal or exceed 300 c.f.s. Total available flows shall include but are not limited to all flows made available by hydropower or other operations at the Aspinall Unit of the Colorado River Storage Project, or which are lawfully stored and lawfully released from storage at the Aspinall Unit pursuant to a water supply contract or lease of storage water for delivery below USGS Gauge No. 09128000 and through the instream flow segment for any purposes. G. The following terms and conditions lower the amount of the donated right that can be called for instream purposes when the Aspinall Unit storage levels fall below certain target storage levels: (1. The CWCB shall not call for the administration of 100 c.f.s. out of the donated water rights as against upstream junior water rights including but not limited to those owned by the City of Gunnison, and shall only call for 200 c.f.s. at any time that the U.S. Bureau of Reclamation determines that the live storage contents of Blue Mesa Reservoir will drop below the end-of-month targets listed below.
