Boulder has demonstrated that the depletive <br />effect of the consumptive use in its municipal water supply system <br />during the April through October period of each year from base <br />(indoor) use and non-base use (lawn, park and open space <br />irrigation, filling of swimming pools and other outdoor use) is as <br />follows: <br /> <br />Month <br /> <br />Percent Decleted <br /> <br />April <br />May <br />June <br />July <br />August <br />September <br />October <br /> <br />21% <br />39% <br />48% <br />53% <br />48% <br />34% <br />17% <br /> <br />The quantity of water available under the subject water rights th~t <br />has historically been or would in the future be consumed ~n <br />Boulder's municipal water supply system if the subject water rights <br />are used for their decreed municipal and related uses rather than <br />for instream flow use hereunder is water that has not returned and <br />would not in the future return to Boulder Creek and that would not <br />be available for use by other water users. Use of that quantity of <br />water for irrigation after the instream flow use of the subject <br />water rights has been completed can be made by lessees of Boulder <br />without causing injury to any vested water right or decreed <br />conditional water right. <br /> <br />5.5 Water available under the subject water rights described <br />in paragraphs 2.1 through 2.5, 2.7 and 2.8 which has been used for <br />instream flow purposes hereunder may be used by lessees of Boulder <br />downstream of the terminus of Segment C described in paragraph 4.1 <br />above, subject to the following terms and conditions: <br /> <br />A. Use of water available pursuant to the terms and <br />conditions of this Part V shall be for irrigation purposes only <br />during the months of April through October of each year and such <br />irrigation use shall be made only by the owners of the ditches <br />described in paragraph 5.2 above pursuant to leases with Boulder. <br /> <br />B. On or before March 15 of each year, Boulder shall <br />furnish copies of leases to state water administration officials <br />and, upon request, to any of the parties hereto. These leases <br />shall include the names of the parties with whom such leases have <br />been entered into, the ditches into which available water is to be <br />
