As you recall, those conditions were
as follows:

1. Releases of water shall be between the period of August and October of 1992 only in the
Yampa River between Hayden, Colorado, and the eastern boundary of Dinosaur National
Monument to enhance habitat conditions for the endangered fish in this reach of the river.

2. There will be no export of water, and the water is nOt needed in Colorado so there will
be no injury to other vested water rightS (Leo no call on the affected stream reach).

3. The Division of Parks will continue to obtain a change-of-use decree for Steamboat Lake
to include downstream piscatorial uses.

4. The water released will be assessed a transponation charge of 10 percent. Therefore. due
to the requested increase in the amount released, a total amount of water reaching Dinosaur
National Monument will be 3.600 acre-feet, assuming 4,000 acre-feet released.

Again, if you desire to operate this proposed plan next year and have not obtained Water Court
approval by that time, please submit a written request one month prior to the date that the operation is
expected to begin.

Sincerely,

Ji; iJ 1:

Hal Simpson,
Acting State Engineer

cc: Ed Blank.
