<br />Draft 4 <br /> <br />'lUiN OF FRISOO <br />SUMMIT CXXJNl'Y, COLORADO <br /> <br />ORDINANCE NO. _ - _ <br /> <br />AN ORDINANCE DESIGNATING FL<XDPLAINS AND ARFA'3 OF SPOCIAL FL<XD HAZARD <br />IN WE 'lUiN OF FRISCO, AND lIDOPl'ING REGULATIOOS TO MINIMIZE LOSSES DUE TO <br />FLOOD HAZARDS, AND ESTABLISHING AOO:INISTRATIVE PROCEDURES FOR PROPERLY <br />ENFORCING SAID REGULATIONS. <br /> <br />WHEREAS, The Board of Trustees of the Town of Frisco has determined it <br />to be in the best interest of the Town, in order to pranote the public <br />health, safety, and general welfare of the citizens of the Town, to <br />designate certain areas as being in a floodplain, and as being in areas of <br />special flood hazard; and, <br /> <br />WHEREAS, The Board of Trustees has determined it to be in the best <br />interest of the Town to participete in the Federal Flood Insurance Program, <br />adninistered formerly by the Federal Insurance Administration, and presently <br />by the Federal Emergency Management Agency; and, to comply with all <br />requiranents of the Federal flood insurance program; and, <br /> <br />WHEREAS, The Board of Trustees, as required by Colorado State Statutes, <br />agrees to comply with all necessary floodplain regulations as determined <br />essential by the Colorado Water Conservation Board, appointed State <br />acbtinistrator of all floodplains in Colorado; and, <br /> <br />NGl, WEREFORE, BE IT ORDIUNED BY WE BOARD OF TRIJSl'EES OF WE TG1N OF <br />FRISCO, CXLORADO: <br /> <br />SOCTION 1. StatutoJ;y Authorization. The regulations contained <br />herein for flood prevention and control are adopted pursuant to int~r alia, <br />Title 29, Article 20, Section 101, ilt~; Title 31, Article 23, Section <br />201, et seq.; and Title 24, Article 65.1, Section 101, ilt~.; CRS 1973, as <br />amended. <br /> <br />SOCTION 2. FINDINGS OF FAcr. The Board of Trustees of the Town of <br />Frisco find that there are within the Town of Frisoo, floodplains which <br />constitute natural hazards of state and local interest, that flooding many <br />cause serious damage, to properties and subject residents of such areas to <br />hazards, that the occupation of such areas may cause the loss of hwnan life <br />and the destruction of property, and that the imprudent use and occupetion <br />of these areas will pose a continuing and greater future damage to life and <br />property unless appropriate regulations are adopted concerning the use and <br />occupation of such hazard areas. <br /> <br />The Town Board of Trustees further finds that flood losses are caused by <br />the clUllulative effect of obstructions in areas of special flood hazards <br />which increase flood heights and velocities, and when inadequately anchored, <br />damage uses in other areas. Uses that are inadequately floodproofed, under <br />elevated, or otherwise unprotected from flood damage also contribute to the <br />flood loss. <br /> <br />Page 3 <br />
