<br />Draft 4 <br /> <br />8.7 Inter;pretation of FIRM Boundaries. '!he Mninistrator <br />shall make interpretations, where needed, as to the exact <br />location of the boundaries of the areas of special flood <br />hazards (for example, where there ap{:ears to be a <br />conflict bet:ween a mapp;!<'! boundary and actual field <br />conditions). '!he {arty contesting the location of the <br />boundary shall be given a reasonable opportunity to <br />ap{:eal the adverse interpretation as provided in the <br />ap{:eal procedures contained herein. <br /> <br />8.8 Vari anCElS and Appeal s. '!he Frisco Board of Adjustment <br />and Ap{:eals ("Ap{:eals Board") as established by the <br />Zoning Ordinance, and appointed by the TCMl1 Board of <br />Trustees, shall hear and decide appeals and request for <br />variances fran the requirenents of this ordinance. <br /> <br />'!he Ap{:eals Board shall hear and decide ap{:eals when it <br />is alleged there is an error in any requirenent, <br />decision, or determination by the Mninistrator in the <br />enforcenent of this ordinance. <br /> <br />'!hose {arties aggrieved by a final decision of the <br />Ap{:eals Board may ap{:eal such decision to a Court of <br />COOl{:etent jurisdiction as provided for by State Statutes. <br /> <br />In {assing upon such applications, the Ap{:eals Board <br />shall consider recommendations and COIIUllents of the Frisco <br />Planning and Zoning Canmission, all technical <br />evaluations, all relevant factors, standards specified in <br />other sections of this ordinance, and: <br /> <br />a. ibe danger that material may be swept onto other <br />lands to the injury of others; <br /> <br />b. ibe danger to life and pro{:erty due to flooding or <br />erosion damage; <br /> <br />c. '!he susceptibility of the proposed facility and its <br />contents to flood damage and the effect of such <br />damage on the individual CMl1er; <br /> <br />d. '!he importance of the services provided by the <br />proposed facility to the Town of Frisco; <br /> <br />e. ibe necessity to the facility of a waterfront <br />location, where applicable; <br /> <br />f. '!he availability of alternative locations, for the <br />proposed use which are not subject to flooding or <br />erosion damage; <br /> <br />Page 20 <br />
