Lupton, CO 80621

Dear Water Purveyor:

You recently received a letter from this Department which identified your
water system as having high nitrate levels. The letter went on to
explain that, at this time, an exemption to the nitrate standard could be
applied for. The conditions for the exemption are as follows:

1.

The nitrate level cannot exceed two times the nitrate standard
(cannot exceed 20 mg/l);
Public notification must be made regularly as set down in the
Colorado Primary Drinkin~ Water Re~ulations;
A compliance achedule must be agreed to which will set a time frame
by which the system .will come into compliance;
Sampling of all water sources, for nitrate levels, will be done
annually to assess the level of health concern;
A written description of what action has been previously taken to
address the nitrate problem.

2.

3.

4.

5.

A proposed compliance schedule is attached for,~our review. The maximum
allowable time period for compliance is three (3) years. Should problems
arise during the three year life of the exemption, which may affect
meeting the time frames, we would need to meet and discuss what changes
to the schedule would be appropriate.

.' :.

After you have reviewed the requirements for an exe~ption, snd considered
the compliance schedule, you will need to apply for the exemption. As
soon as the requirements have been met and submitted to us, we can begin
processing the request. A signed compliance schedule will be required.
Attached is a copy of a nitrate treatment study prepared by the
department for your information.

RECEI\iEO JUL 1 I} 1988
