<br />WHEREAS, the Town of Parker, Colorado, has not requested the Colorado Water ! <br />Conservation Board to rescind any of the detailed or approximate floodplain information contained in <br />Resolutions Nos. 96-428 and 96-429; and <br /> <br />c.R.S. AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or basins and <br />to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />COMPLIANCE WITH CWCR TECHNICAL STANDARDS <br /> <br />WHEREAS, the detailed information in said new report for the stream reaches listed in <br />Table 2, including the stream reach inadvertently omitted in Resolutions Nos. 96-428 and 96-429, as <br />listed in Table 5, meets all of the requirements for detailed information listed under the Board's "Rules <br />and Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater <br />Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the approximate information in said new report for the stream reach listed in <br />Table 3, which is also the stream reach incorrectly described in Resolutions Nos. 96-428 and 96-429 as <br />being part of Tallman Gulch instead of Tallman Gulch Tributary, as listed in Table 4, meets all of the <br />requirements for approximate information listed under the Board's "Rules and Regulations for the <br />Designation and Approval of Floodplains and of Storm or Floodwater Runoff Channels in <br />Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the floodplain information in said new report for the stream reach listed in <br />Table 6 was the official floodplain information for the Town of Parker for the purposes of the National <br />Flood Insurance Program from July 4, 1989 until March 2, 1993, for that stream reach only, previously <br />met all of the requirements for detailed information listed under the Board's "Rules and Regulations <br />for the Designation and Approval of Floodplains and of Storm or Floodwater Runoff Channels in <br />Colorado" (2 CCR 408-1), but became outdated and superseded after March 2,1993; and <br /> <br />6 <br />
