Box 419 <br />Alamosa, CO 81101 <br /> <br />Dear Mr. Sparks: <br /> <br />Thank you for your letter dated December 19, 1985 responding to <br />our concerns regarding flood plain development and in particular, <br />the possible floodway encroachment at the Riverwood Estates <br />Subdivision. We appreciate your addressing the various flood <br />plain issues, however, we feel some clarification is necessary and <br />offer the following comments. <br /> <br />First, as a participant of the National Flood Insurance Program <br />(NFIP), the City adopted a flood plain ordinance on October 19, <br />1977 which provides standards for floodway development. <br />Section 5.3 of the ordinance entitled .Floodways. specifically <br />addresses floodway development. In addition, the City's ordinance <br />adopted the Flood Insurance Study (PIS), dated September 15, 1977, <br />including the Flood Insurance Rate Map (PIRMI and the Flood <br />Boundary and Floodway Map (PBFM). As shown on the City's FBFM <br />(copy enclosed), there is a floodway depicted along the Rio Grande <br />River. The FBFM, along with the Floodway Tables in the PIS, <br />should be used to regulate floodway development. <br /> <br />Second, there are various responsibilities of the City as a <br />participant of the NFIP. One responsibility of the City is to <br />formally adopt flood hazard data, including floodways, whenever <br />annexation occurs. Another responsibility of the City, as stated <br />in Title 44 Part 65, Section 65.3 of the Federal Register, is to <br />notify the Federal Emergency Management Agency (FEMA), in writing, <br />whenever the boundaries of the City have been modified by <br />annexation and to provide a copy of the City map suitable for <br />reproduction. As you know, a portion of the Rio Grande River was <br />annexed by the City as a result of the RiverwoodEstates <br />SlIbdivision annexation. A floodway exists along this area which <br />is shown on the County's FBPM (copy enclosed). Therefore, to be <br />in compliance with the NFIP, the City MUst adopt this floodvay. <br /> <br />Third, it is also the City's responsibility to prohibit <br />encroachments, including fill, new construction, sllbstantial <br />
