<br />This letter is in response to your recent correspondence regarding possible
<br />floodway encroachment in the City of Alamosa, specifically:
<br />

<br />1) Levees along the Rio Grande River at Riverwood Estates Subdivision
<br />2) Residential structures within the Riverwood Estates Subdivision.

<br />The levees that were constructed at Riverwood were constructed prior to City
<br />annexation of June, 1983. The developer (Dale Andersen) obtained a Corps of
<br />Engineers 404 permit which resulted in channel work and levee construction
<br />in the Riverwood area. The permit was granted following a lengthy review by
<br />state and federal agencies. The levees at Riverwood do not meet FEMA's standard
<br />of three feet of freeboard above the 100 year flood. As FEMA and the Corps of
<br />Engineers know, none of the Alamosa levee system presently meets any established
<br />design criteria for flood protection. The levees were developed over the past
<br />forty years by various developers, contractors, and by City/County forces.

<br />At the time of Riverwood's annexation, no one was aware of a floodway problem.
<br />In fact, in Alamosa's Flood Insurance Rate map, no portion of the city, including
<br />a City owned section of the river, is identified as being in the f1oodway. It
<br />would seem to me, that if the river channel was not identified as a floodway,
<br />then Riverwood which was partially filled and protected by a levee would not be
<br />considered as an encroachment in the floodway.

<br />In response to your inquiry regarding residential units constructed in the
<br />floodway at Riverwood the City had no knowledge of the floodway when this area
<br />was incorporated into the city.
