<br />.' <br /> <br />3 <br /> <br />We are incorporating new detailed flood hazard information for Monument Creek <br />into FIRM Panel 0163 B and the FIS report as a physical map revision. We <br />will also incorporate the modifications described in this LOMR into FIRM <br />Panel 0164 B and the FIS report. Before publishing the revised panel and FIS <br />report, we will issue preliminary copies for review by your community. The <br />preliminary copies are scheduled to be delivered for review in October 1994. <br />The revisions to Panel 0163 B are to incorporate a LOMR dated February 15, <br />1994. <br /> <br />The basis of this LOMR is, in whole or in part, a channel- <br />modification/culvert project. NFIP regulations, as cited in Paragraph <br />60.3(b)(7), require that communities assure that the flood-carrying capacity <br />within the altered or relocated portion of any watercourse is maintained. <br />This provision is incorporated into your community's existing floodplain <br />management regulations. Consequently, the ultimate responsibility for <br />maintenance of the channel mOdification/culvert rests with your community. <br /> <br />The map panel as listed above and as revised by this letter will be used for <br />all flood insurance policies and renewals issued for your community. <br /> <br />This determination has been made pursuant to Section 206 of the Flood <br />Disaster Protection Act of 1973 (Public Law 93-234) and is in accordance with <br />the National Flood Insurance Act of 1968, as amended (Title XIII of the <br />Housing and Urban Development Act of 1968, Public Law 90-448), 42 U.S.C. <br />4001-4128, and 44 CFR Part 65. Because of the modifications to the FIRM for <br />your community made by this LOMR, certain additional requirements must be met <br />under Section 1361 of the National Flood Insurance Act of 1968, as amended, <br />within 6 months from the date of this letter. Prior to February 3, 1995, <br />your community is required, as a condition of continued eligibility in the <br />NFIP, to adopt or show evidence of adoption of floodplain management <br />regulations that meet the standards of Section 60.3(d) of the NFIP <br />regulations. These standards are the minimum requirements and do not <br />supersede any State or local requirements of a more stringent nature. <br /> <br />It must be emphasized that all of the standards specified in Section 60.3(d) <br />of the NFIP regulations must be enacted in a legally enforceable document. <br />This includes adoption of the effective FIRM and FIS report to which <br />regulations apply and the modifications made by this LOMR. Some of the <br />standards should already have been enacted by your community. Any additional <br />requirements can be met by taking one of the following actions: <br /> <br />1. Amending existing regulations to incorporate any additional <br />requirements of Section 60.3(d); <br /> <br />2. Adopting all of the standards of Section 60.3(d) into one new, <br />comprehensive set of regulations; or <br /> <br />3. Showing evidence that regulations have previously been adopted that <br />meet or exceed the minimum requirements of Section 60.3(d). <br /> <br />Communities that fail to enact the necessary floodplain <br />regulations will be suspended from participation in the NFIP and <br />the prohibitions contained in Section 202(a) of the Act as amended. <br /> <br />management <br />subject to <br />
