<br />317.3.1.2 <br /> <br />The Owner fails to pay any sum finally due, after any proceeding <br />under Section 317. <br /> <br />317 .3.2 <br /> <br />Work shall continue if within the ten (10) day notice period the <br />situation which justified suspension by the Contractor under this <br />Section is remedied. <br /> <br />317.4 Termination by Contractor <br /> <br />317.4.1 The Contractor may terminate the :ontract and recover any sums due for <br />Work performed, materials purchased and other reasonable expenses, <br />including reasonable termination expenses, upon ten (1) days' written <br />notice to the Owner should one of the following events occur; <br /> <br />317.4.1.1 Suspension of the Work through nc fault of the Contract by court <br />order or other act by a public authority with proper jurisdiction <br />for a period in excess of ninety (90) days. <br /> <br />317 ,,4 .1.2 <br /> <br />Failure of the Engineer to act on any Appl ication for Payment <br />within thirty (30) days aftel" it is submitted. <br /> <br />Failure of the Owner to may any payment determined to be finally <br />due thirty (30) days of the due date, after any proceeding under <br />Section 317. <br /> <br />317.4.1.3 <br /> <br />317.4.2 <br /> <br />Nothing in this section shall relieve the Contractor from the <br />responsibility to continue Work eluting the resolution of disputes <br />between the Owner and the Contractor" <br /> <br />GC - 27 <br />
