<br />306.8.2 Final Payment not Substantial completion for the .lOrk performed under this <br />contract will not be made until the Owner gives preliminar'y approval and <br />acceptance of the project. <br /> <br />306.8.3 Within sixty (60) days of approval of the Final I\pplication for Payment, <br />the Owner shall make final payment to the Contractor of all amounts due <br />under the Contract and any Change Orders and all amounts previously <br />reta i ned. <br /> <br />306.8.4 Final payment by the Owner shall constitute acceptance of the "roject by <br />the Owner and a waiver of all claims against tile Contractor, except <br />those for unsettled claims by Subcontractors or other suppl"iers, defects <br />or omissions arising which were not discoverable upon reasonable inspec- <br />tion by the Engineer, failure of the Contractor to perform any part of <br />the Project in compl iance with the Contract Documents, or any defects <br />which are discovered within one (1) year of final completion. <br /> <br />307. COMPLETION OF THE PROJECT <br /> <br />307.1 Substantial Completion <br /> <br />307.1.1 When the Contractor considers the Project to be substantially complete, <br />he shall so certify to the Engineer. Viithin ten (10) days of such <br />certification, the Engineer shall inspect the Project and determine the <br />status of completion. Within ten (10) days, the Engineer shall decide <br />whether or not to issue a Certificate of Substantial Completion and/or a <br />I ist of unfinished work to be done and corrections to be made and the <br />date by which such work is to be done. If in the opinion of the Engineer, <br />the 1 ist of unfinished work to pe done, or deficient or defecLive work to <br />be corrected is excessive, the Engineer will not issue a Certificate of <br />Substantial Completion. If the Engineel" does not issue a Certi ficate of <br />Substantial Completion, he shall state "is reasons in writ"ing to the <br />Contractor. <br /> <br />307.1..2 The Engineer shall make one inspection at the time the Contractor <br />requests a Certificate of Substantia"' Completion for all or any portion <br />of the Project. If additional inspect"ions are required because the <br />Contractor's work is not substantially complete, in the Engineer's <br />judgement, each subsequent inspection of the same work for the purpose <br />of obtaining a Certificate of Substantial Comp"fetion shall be at the <br />sole expense of the Contractor. <br /> <br />307.2 Final Completion <br /> <br />When the Contractor believes the PrOject is finally completed, he shall <br />so certify to the Owner and Engineer. The Owner, Contractor and Engineer <br />will then inspect the Project. The Engineer will notify the Contractor <br />of any patently deficient or patently defective work that is not in <br />con formance with the Contract Documents. <br /> <br />307.2.1 The Engineer shall review the final Appl ication for Payment, all the <br />reqUired supporting documents and make a final observation of the work. <br /> <br />GC - 10 <br />
