<br />COLORADO FLOOD CONTROL <br />NIl DRAINAGE LAWS <br /> <br />NOTE <br /> <br />LIMITATIONS <br /> <br />County financing is controlled by numerous other <br />statutes. The more generally applicable statute is <br />30-25-101--206, on County finance. However, <br />30-25-106 limits the use of general fund financing <br />to projects and purposes which do not include pUblic <br />works. and purposes which are voted upon. <br /> <br />Alternative financing for projects and purposes <br />which are otherwise authorized for counties is <br />provided by the County Capital Improvement Trust <br />Fund Financing Act (1982). which provides for the <br />creation and use of a special fund for capital <br />improvements. This would presumably allow use of <br />the fund for drainage and flood control projects as <br />they are authorized in the manner described above <br />(30-26-501--513). <br /> <br />It might be noted also that home rule counties may <br />have capacities which are different from and larger <br />than those for normal counties. Finally, note that <br />title 29 contains limitations on the ability of <br />local governments to increase their tax levies and <br />assessments. in some cases. from one year to the <br />next (29-1-301--305). <br /> <br />As well as limitations <br />requirements applicable to <br />the following limitations <br />powers described here: <br /> <br />in <br />the <br />are <br /> <br />the procedures and <br />particular statutes. <br />applicable to the <br /> <br />Boards of county commissioners may not create debt <br />to finance any of the purposes in 30-11-107 (see <br />Special Powers. I-B-l) without election approval <br />(30-11-108). <br /> <br />"Public projects" under 30-20-301 et seg. may not be <br />funded by general obligation bonding, or other use <br />of the credit of the county (30-20-309). <br /> <br />No general obligation funding is allowed for the <br />projects authorizl~d under 30-20-401 et seq., either <br />(30-20-402). <br /> <br />No revenue bonds can be obligations of the county <br />(30-20-408). <br /> <br />I-B-5 <br />
