"Standards and technical procedures applicable to
storm drainage plans and related designs. in order
to ensure proper drainage ways. which may require.
in the opinion of the board of county commissioners.
detention facilities which may be dedicated to the
county or the public. as are deemed necessary to
control, as nearly as possible. storm waters
generated exclusively within a subdivison from a one
hundred year storm which are in excess of the
historic runoff volume of water from the same land
area in its undeveloped and unimproved condition."

SUbdivision regulations may also provide for payment
of an equitable contribution to a regional
development of drainage basins. which. must be part
of the master plan for the area (30-28-106(3) (d).
-133(11)0. The sUbdivison regulations may require
any information needed to evaluate compli.ance with
the standards. and thus may vary widely depending on
local conditions.

"'Subdivision' or 'subdivided land' means any parcel
of land in the State which is to be used for
condominiums. apartments. or any other multiple
dwelling units. unless such land when previously
subdivided was accompanied by a filing which
complied with the provi.sions...with substantially
the sarite density. or which is divided into two or
more parcels, separate interests, or interests in
common, unless exempted. . . " As used in this
section, "interests" includes any and all interests
in the surface of land but excludes any and all
subsurface interests. (30-28-101(10)(01)). The
exemptions include:

o any division of land which creates parcels each
of which is 35 or more acres of land and none of
which is intended for use by multiple owners is
not a subdivision (30-28-101(10(b)).

o "Creates parcels of land, such that the land of
each of the parcels, when divided b}' the number
of interests in any such parcel. results in
thirty-five or more acres per interest."

o A division of land created by a lien. mortgage,
deed of trust. or other security instrument. or
by a security or unit of interest in an
investment trust regulated by the State, or
another interest in an investment entity, or is
created by the acquisition of land in joint
tenancy or as tenants in common or in the name of
