The sUbdivison regulations may require <br />any information needed to evaluate compli.ance with <br />the standards. and thus may vary widely depending on <br />local conditions. <br /> <br />"'Subdivision' or 'subdivided land' means any parcel <br />of land in the State which is to be used for <br />condominiums. apartments. or any other multiple <br />dwelling units. unless such land when previously <br />subdivided was accompanied by a filing which <br />complied with the provi.sions...with substantially <br />the sarite density. or which is divided into two or <br />more parcels, separate interests, or interests in <br />common, unless exempted. . . " As used in this <br />section, "interests" includes any and all interests <br />in the surface of land but excludes any and all <br />subsurface interests. (30-28-101(10)(01)). The <br />exemptions include: <br /> <br />o any division of land which creates parcels each <br />of which is 35 or more acres of land and none of <br />which is intended for use by multiple owners is <br />not a subdivision (30-28-101(10(b)). <br /> <br />o "Creates parcels of land, such that the land of <br />each of the parcels, when divided b}' the number <br />of interests in any such parcel. results in <br />thirty-five or more acres per interest." <br /> <br />o A division of land created by a lien. mortgage, <br />deed of trust. or other security instrument. or <br />by a security or unit of interest in an <br />investment trust regulated by the State, or <br />another interest in an investment entity, or is <br />created by the acquisition of land in joint <br />tenancy or as tenants in common or in the name of <br /> <br />I II -B-2 <br />
