<br />Federal Emergency Management Agency <br /> <br />as a flash flood or an abnormal tidal <br />surge, or by some similarly unusual <br />and unforeseeable event which results <br />In flooding. <br />"Flood-related erosion area U or <br />''liood-related . erosion prone area" <br />means a land area adjoining the shore <br />of a lake or other body of water, which <br />due to the composition of the shore- <br />line or bank and high water levels or <br />wind-driven currents, Is likely to suffer <br />flood-related erosion damage. <br />"Flood-related erosion area manage- <br />ment" means the operation of an over- <br />all program of corrective and preven- <br />tive measures for reducing flood-relat. <br />ed erosion damage, including but not <br />limited to emergency preparedness <br />plans. flood-related erosion control <br />works, and flood plain management <br />regulations. <br />uFloodway"-see "regulatory flood- <br />way," <br />"Floodway encroachment lines" <br />mean the lines marking the limits of <br />floodways on Federal, State and local <br />flood plain maps. <br />"Freeboard" means a factor of safety <br />usually expressed In feet above a flood <br />level for purposes of flood plain man- <br />agement. "Freeboard" tends to com- <br />pensate for the many unknown factors <br />that could contribute to flood heights <br />greater than the height calculated for <br />a selected size flood and floodway con- <br />ditions, such as wave action, bridge <br />openings, and the hydrological effect <br />of urbanization of the watershed. <br />"Functionally dependent use" means <br />a use which cannot perform Its intend- <br />ed purpose unless It Is located or car- <br />ried out In close proximity to water. <br />The term Includes only docking facili- <br />ties, port facilities that are necessary <br />for the loading and unloading of cargo <br />or passengers, and ship building and <br />Ship repair facilities, but does not in- <br />clude long-term storage or. related <br />manufacturing facilities. <br />uGeneral Counsel~' means the Gen- <br />eral Counsel of the Federal Emergen- <br />cy Management Agency. <br />"Highest ad,jacent grade" means the <br />highest natural elevation of the <br />ground surface prior to construct.ion <br />next to the proposed walls of a struc- <br />ture. <br />I'Hi8toric Structure" means any <br />structure that Is: <br /> <br />fi59.1 <br /> <br />(a) Listed Individually In the Nation- <br />al Register of Historic Places (a listing <br />maintained by the Department of In- <br />terior) or preliminarily determined by <br />the Secretary of the Interior as meet- <br />Ing the requirements for Individual <br />listing on the National Register; <br />(b) Certified or preliminarily deter- <br />mined by the Secretary of the Interior <br />as contributing to the historical sig- <br />nificance of a registered historic dis- <br />trict or a district prellm1narlly deter- <br />mined by the Secretary to qUalify as a <br />registered historic district; <br />(c) Individually listed on a state in. <br />ventory of historic places in states <br />with historic preservation programs <br />which have been approved by the Sec- <br />retary of the Interior; or <br />(d) Individually listed on a local in- <br />ventory of historic places in communi- <br />ties with historic preservation pro- <br />grams that have been certified either: <br />(I) By an approved state program as <br />determined by the Secretary of the In- <br />terior or <br />(2) Directly by the Secretary of the <br />Interior In states without approved <br />programs. <br />"Independent scientific body" means <br />a non-federal technical or scientific or- <br />ganization Involved In the stUdy of <br />land use planning, flood plain manage- <br />ment. hydrology, geology, geography. <br />or any other related field of study con- <br />cerned with flooding. <br />"Insurance adjustment organiza. <br />tion" means any organization or <br />person engaged in the business of ad- <br />Justing loss claims arising under the <br />Standard Flood InsurancePollcyo <br />"Insurance company" or "insurer" <br />means any person or organization au- <br />thorized to engage In the Insurance <br />business under the laws of any Stateo <br />"Levee" means a man.made struc. <br />ture, usually an earthen embankment, <br />designed and constructed in accord- <br />ance with sound engineering practices <br />to contain, control, or divert the flow <br />of water so as to provide protection <br />from temporary flooding. <br />"Levee System" means a flood pro- <br />tection system which consists of . <br />levee, or levees. and associated struc. <br />tures, such as closure and drainage- de- <br />vices, which are constructed and oper. <br />ated in accordance with sound engi- <br />neering practices. <br /> <br />249 <br />
