Redesignated at <br />44 FR 31177, May 31, 19791 <br />fi 59.24 Suspension of community eligibil- <br />Ity. <br />(a) A community eligible for the sale <br />of flood insurance shall be sUbject to <br />suspension from the Program for fail- <br />Ing to submit copies of adequate flood <br />plain management regulations meet- <br />Ing the minimum requirements of <br />paragraphs (b), (c), (d) or (e) of ! 60.3 <br />or paragraph (b) of ! 60.4 or ! 60.5, <br />within six months from the date the <br />AdminIStrator provides the data, upon <br />which the flood plain regulations for <br />the appUcable paragraph shall be <br />based. Where there has not been any <br />submission by the community, the Ad- <br />ministrator shall notify the communi- <br />ty that 90 days remain In the six <br />month period in order to submit ade- <br />quate flood plain management regula- <br />tions. Where there has been an inad, <br />equate submission, the Administrator <br />shall notify the community of the spe- <br />cific deficiencies in its submitted flood <br />plain management regulations and <br />inform the community of the amount <br />of time remaining within the six <br />month period. If, subsequently, copies <br />of ad('quate flood plain management <br />regulations are not received by the Ad- <br />ministrator, he shall, no later than 30 <br />days before the expiration of the origi- <br />nal six month period, provide written <br />notice to the community and to the <br />state and assure publication In the <br />FEDERAL REGISTER under Part 64 of <br />this subchapter, of the community's <br />loss of eligibility for the sale of flood <br />insurance. such suspension to. become <br />effective upon the expiration of the <br />six month period. Should the commu- <br />nity remedy the defect and the Ad- <br />ministrator receive copies of adequate <br />flood plain management regulations <br />within the notice period, the suspen- <br />sion notice shall be rescinded by the <br />Administrator, If the Administrator <br />receives notice from the State that It <br />has enacted adequate flood plain man- <br /> <br />~ 59.24 <br /> <br />agement regulations for the communi- <br />ty within the notice period, the sus- <br />pension notice shall be rescinded by <br />the Administrator.' The community's <br />eligibility shall remain terminated <br />after suspension until copies of ade- <br />quate flood plain management regula- <br />tions have been received and approved <br />by the AdminIStrator. <br />(b) A community eligible for the sale <br />of flood insurance which falls to ade- <br />quately enforce flood plain manage- <br />ment regulations meeting the mini- <br />mum requIrements set forth In H 60.3, <br />60.4 and/or 6005 shall be subject to <br />probation. Probation shall represent <br />formal notification to the conununity <br />that the Administrator regards the <br />community's flood plain management <br />program as not compliant with NFIP <br />criteria. Prior to imposing probation, <br />the Administrator (1) shall Inform the <br />community upon 90 days prior,written <br />notice of the impending probation and <br />of the specific program deficiencies <br />and violations relative to the failure t<J <br />enforce, (2) shall, at least 60' day, <br />before probation Is to begin, issue a <br />press release to local media explaining <br />the reasonsfQr and the effects of pro. <br />bation, and (3) when the probation il <br />to begin on or after October 1, 1986, <br />shall, at least 90 days before probatio, <br />is to begin, adVIse all policyholders i, <br />the community of the impending pro, <br />bation and the additional premhm <br />that will be charged, as provided lr <br />this paragraph, on policies sold or reo <br />newed during the period of probation <br />During this 90-day period the commu <br />nity shall have the opportunity t< <br />avoid probation by demonstratln! <br />compliance with Program. require <br />ments, or by correcting Program defl <br />ciencies and remedying all violation: <br />to the maximum extent possible. If, a1 <br />the end of the 90-day period, the Ad <br />mlnlstrator determines that the com <br />munity has failed to do so, the proba <br />tion shall go into effect. ProbatiOI <br />may be continued for up to one yea] <br />after the community corrects all Pro <br />gram deficiencies and remedies all vlo <br />lations to the maximum extent possi <br />ble.
