<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Descriptions of Designated or Regulated Flood Hazard Areas <br /> <br />5-303 <br /> <br />This jurisdiction hereby declares that all floodplains which <br />are heretofore or hereafter identified and designated as flood hazard <br />areas in order to meet the purposes and intent of these regulations <br />shall be listed herein: <br /> <br />(1) The flood hazard initial control area(s) shown on the <br />following described map(s) were designated or subjected <br />to regulation on <br /> <br />(2) where sufficient data are available to determine the effect <br />thereof on existing or foreseeable land uses, the flood- <br />plain may be divided into a floodway zone and a low hazard <br />zone. <br /> <br />(3) The floodway and low hazard zones shown on the following <br />described map(s) were designated or subjected to regu- <br />lation on <br /> <br />Flood Elevations Take Precedence Over Map Boundaries <br /> <br />5-304 <br /> <br />The boundaries of all flood hazard areas on the above maps <br />shall be established by flood elevations. In the event of conflict <br />over the location of any such boundary as shown on the above maps, <br />reference shall be made to the flood elevations which shall take <br />precedence over the boundaries shown on the maps. <br /> <br />Article 4. <br /> <br />Applications and Permits <br /> <br />5-401 Procedural Requirements <br /> <br />(1) The procedures concerning permit applications, hearings, <br />review of permit authority decisions and issuance of per- <br />mits set forth in Article 4 of the Administrative Regula- <br />tions adopted by this jurisdiction shall be followed if <br />the flood hazard area was designated pursuant to 8824-65. <br />1-101, et seq., C.R.S. 1973. <br /> <br />(2) If the area was regulated under H.B. 1034 (1974), ~~29- <br />20-101, et seq., C.R.S. 1973, any procedures adopted by <br />this jurisdiction pursuant to said II.B. 1034 (1974) shall <br />control. <br /> <br />I <br />I <br />I <br />I <br /> <br />6-402 Application Fee <br /> <br />Any application for a permit to engage in development in a <br />designated flood hazard area shall be accompanied by non-refundable <br />fees in the amount of not more than ten (10) percent of the total <br />cost of the development but such fee shall be no greater than the <br /> <br />-9- <br />
