<br />I <br /> <br />I <br />I <br /> <br />this Chapter 5. <br /> <br />(2) No person shall engage in any development in any low <br />hazard zone without a permit. <br /> <br />I <br />I <br />I <br /> <br />(3) Except as may be provided elsewhere in these requlations, <br />development in the low hazard district shall be designed <br />so that: <br /> <br />(a) The development proscribed in S5-202(3) (a) and (b) <br />shall not be allowed in the low hazard zone. <br /> <br />(b) Such development shall not cause an enlargement of <br />the floodplain so as to cause damages to or on lands <br />other than those owned by the developer. <br /> <br />I <br /> <br />(c) Any residential or nonresidential building or struc- <br />ture, whether fixed or mobile, designed for human <br />occupancy or the storage of property, and occupying <br />a space greater than one hundred square feet, shall <br />be constructed, located, or improved so that any <br />external wall shall be not less than fifteen (15) <br />feet from the stream side of the low hazard zone. <br /> <br />I <br />I <br />I <br /> <br />(d) The lowest floor of any such building or structure <br />shall be not less than one foot above the maximum <br />water elevation of the computed intermediate region- <br />al flood, unless such building or structure has been <br />adequately floodproofed to or over one foot above <br />said maximum water elevation. <br /> <br />I <br /> <br />I <br />I <br /> <br />(e) In the event that the fioodwaters in a low hazard <br />zone can be expected to attain a velocity greater <br />than three (3) feet per second (at any point where <br />the proposed added development is to occur,) addi- <br />tional floodproofing shall be required sufficient <br />to withstand such greater water velocity. <br /> <br />I <br />I <br /> <br />(4) A permit to engage in development in low hazard zones <br />may be issued by the permit authority only if the follow- <br />ing design and performance standards are met: <br /> <br />I <br /> <br />(a) with respect to new construction or substantial improve- <br />ments, be designed so that the proposed construction <br />(including prefabricated homes) is anchored to prevent <br />flotation, collapse, or lateral movement of the <br />structure. <br /> <br />I <br /> <br />(b) Be consistent with the need to minimize flood damage. <br /> <br />I <br />I <br /> <br />-7- <br />
