In all cases, a person contesting the
location of the Designated Geologic Hazard Area boundary
or the severity of conditions at a specific location with-
in the Designated Geologic Hazard Area shall be given a
reasonable opportunity to present his case to the Board
and shall submit technical and geologic evidence to support
such contest. The Board shall not allow deviations from
the boundary line as mapped or non-permitted land uses
within the boundary areas unless technical and geological
evidence clearly and conclusively establishes that the map
location of the line is incorrect, or that the Designated
Hazard conditions do not present a significant hazard to
public health, safety or to property at the specific loca-
tion within the hazard area boundary for the particular
proposed land use.

3-402 Application Fee

Any application for a permit to engage in development in a
designated geologic hazard area shall be accompanied by nonrefun-
dable certified funds in the amount of not more than 10% of the
total cost of the development, but in no event should such amount
exceed the amount which may be required by the permit authority
sufficient to cover the cost incurred ~n the review and approval
of the permit application, including all hearings conducted therefore.

3-403 Applicant's Submission Requirements

(1) Applicants seeking to engage in development in a geologic
hazard area shall submit to the permit authority, as a
minimum, four copies of the following information, maps,
reports, or data:

(a) A completed permit application form;

(b) An index map showing the general location of the permit
area and its relationship to surrounding topographic
and cultural features. A standard U.S.G.S. yuadrangle
map would usually be adequate for an index map.

(e) A topographic map or maps showing location, nature and
density of the proposed development or land use change.

-11-
