<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />8824-65.1-101, et. seq., C.R.S. 1973. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />(2) Mapping Disputes: The following procedure shall be used <br />by the County Commissioners in deciding contested cases <br />in which the boundary of a designated Geologic Hazard Area <br />is disputed or in cases where because of local, detailed <br />circumstances, the designated hazard condition does not <br />present a significant hazard to public health, safety or <br />to property at the specific location for the particular <br />proposed land use. In all cases, a person contesting the <br />location of the Designated Geologic Hazard Area boundary <br />or the severity of conditions at a specific location with- <br />in the Designated Geologic Hazard Area shall be given a <br />reasonable opportunity to present his case to the Board <br />and shall submit technical and geologic evidence to support <br />such contest. The Board shall not allow deviations from <br />the boundary line as mapped or non-permitted land uses <br />within the boundary areas unless technical and geological <br />evidence clearly and conclusively establishes that the map <br />location of the line is incorrect, or that the Designated <br />Hazard conditions do not present a significant hazard to <br />public health, safety or to property at the specific loca- <br />tion within the hazard area boundary for the particular <br />proposed land use. <br /> <br />3-402 Application Fee <br /> <br />Any application for a permit to engage in development in a <br />designated geologic hazard area shall be accompanied by nonrefun- <br />dable certified funds in the amount of not more than 10% of the <br />total cost of the development, but in no event should such amount <br />exceed the amount which may be required by the permit authority <br />sufficient to cover the cost incurred ~n the review and approval <br />of the permit application, including all hearings conducted therefore. <br /> <br />3-403 Applicant's Submission Requirements <br /> <br />(1) Applicants seeking to engage in development in a geologic <br />hazard area shall submit to the permit authority, as a <br />minimum, four copies of the following information, maps, <br />reports, or data: <br /> <br />(a) A completed permit application form; <br /> <br />(b) An index map showing the general location of the permit <br />area and its relationship to surrounding topographic <br />and cultural features. A standard U.S.G.S. yuadrangle <br />map would usually be adequate for an index map. <br /> <br />(e) A topographic map or maps showing location, nature and <br />density of the proposed development or land use change. <br /> <br />-11- <br />
