<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />.Article 4. <br /> <br />Applications and Permits <br /> <br />2-401 Procedural Requirements. <br /> <br />(1) The procedures concerning permit applications, hearings, <br />review of permit authority decisions and issuance of permits <br />set forth in Article 4 of the Administrative Regulations <br />adopted by this jurisdiction shall be followed if the mineral <br />resource area was designated pursuant to 8824-65.101, et seq., <br />C.R.S. 1973. <br /> <br />(2) <br /> <br />If the area was <br />et seq., C.R.S. <br /> <br />regulated under H.B. <br />1973, the procedures <br />sh,'\ll control. <br /> <br />1034 (1974), 8829-20-101, <br />set forth in section <br /> <br />(3) All persons owning mineral rights which would be affected by <br />the proposed permit shall be given adequate and proper notice <br />of the permit hearing. <br /> <br />(4) upon receipt by the permit authority, a completed permit <br />application shall be forwarded to those agencies noted in <br />2-405 (1) (f), below. The agencies named in that section shall <br />be allowed thirty (30) days after forwarding of a completed <br />application in which to make recommendations. <br /> <br />2-402 Application Fee. <br /> <br />Any application for a permit to engage in development in a desig- <br />nated mineral resource area shall be accompanied by nonrefundable cer- <br />tified funds in the amount of not more that ten (10) percent of the <br />total cost of the development, but in no event shall such amount exceed <br />the amount which may be required by the permit authority sufficient to <br />cover the costs incurred in the review and approval of the permit appli- <br />cation, including all hearing~ conducted therefor. <br /> <br />2-403 Waiver of Submission Requirements. <br /> <br />(1) The permit authority may waive any part but not all of the <br />submission requirements imposed by this tegulation upon peti- <br />tion of the applicant that full compliance with the submission <br />requirements would ~e unreasonably burdensome for the appli- <br />cant and that the Proposed development will have an insub- <br />stantial impact on the surrounding area. Such a waiver may <br />be granted, after due consideration by the permit authority, <br />upon a written determination that the information to be sub- <br />mitted is sufficient for the permit authority to arrive at a <br />permit decision in full compliance with the law and these <br />regulations and that the proposed development will have an <br />insubstantial impact on the surrounding area. <br /> <br />-l~- <br />
