<br />. <br /> <br />. <br /> <br />. <br /> <br />1-501 <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />I <br /> <br />. <br /> <br />Article 5 <br /> <br />Administration, Enforcement, and Penalties <br /> <br />Enforcement and Penalties <br /> <br />(1) Any person engaging in a development in a desig- <br />nated area of state interest or conducting a <br />designated activity of state interest who does not <br />obtain a permit pursuant to these regulations for <br />administration, who does not comply with permit <br />requirements, or who acts outside the authority of <br />the permit, may be enjoined by this jurisdiction <br />or the Land Use Commission from engaging in such <br />development or conducting such activity, and may <br />be subject to such other criminal or civil lia- <br />bility as may be prescribed by law. <br /> <br />(2) (If the governing body is a municipality,) any <br />person knowingly engaging in a development in a <br />designated area of state interest or conducting a <br />designated activity of state interest who does not <br />obtain a permit pursuant to these regulations for <br />administration, who does not comply with permit <br />requirements, or who acts outside the authority of <br />the permit, shall be guilty of a misdemeanor and <br />subject to a fine of not more than three hundred <br />dollars ($300), imprisonment for not more than <br />ninety (90) days, or both. <br /> <br />l-502 Mapping Disputes. <br /> <br />I <br /> <br />. <br /> <br />I <br /> <br />I <br /> <br />1-503 <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />. <br /> <br />(1) Where interpretation is needed as to the exact <br />location of the boundary of any designated area and <br />where there appears to be a conflict between a <br />mapped boundary and actual field conditions, the <br />permit authority shall make the necessary determina- <br />tion of the boundary. Any person contesting the <br />location of the boundary shall be given an oppor- <br />tunity to present his/her case to the permit authority. <br /> <br />(2) The determination of the permit authority may be <br />appealed to the governing bOdy of this jurisdiction. <br /> <br />Inspection. <br /> <br />(1) The permit authority or its authorized represen- <br />tative is hereby empowered and directed to inspect <br />and examine the use, occupation or development of <br />or activity in each and every area or activity sub- <br />ject to these regulations for the purpose of deter- <br />mining from time to time whether or not any use, <br /> <br />-22- <br />
