<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />such costs where recovery is deemed possible. <br /> <br />1-409 Review of Permit Authority Decision by <br />Governing Body. <br /> <br />(1) The provisions of this section shall apply only if <br />the governing body is not the permit authority for <br />this jurisdiction. <br /> <br />I <br /> <br />(2) Any person affected by a decision of the permit <br />authority may obtain review of that decision by <br />the governing body by written notice of appeal <br />which specifies the basis of objections and which <br />is filed with the permit authority and the govern- <br />ing body not later than twenty (20) days after the <br />permit authority makes the decision. <br /> <br />I <br /> <br />(3) The governing body shall review the decision of the <br />permit authority at a public hearing held within <br />thirty (30) days, or at the governing body's second <br />regular meeting, after the notice of appeal is filed, <br />whichever is later. If the governing bOdy fails to <br />reach a decision within 120 days of filing of appeal, <br />the appeal shall be deemed to be successful. <br /> <br />I <br />I <br /> <br />(4) Notice shall be given and the public hearing shall <br />be conducted in substantially the same manner as the <br />permit hearing conducted by the permit authority. <br /> <br />I <br /> <br />(5) During the pendency of any appeal to the governing <br />body and during any judicial review thereof, the <br />applicant may not engage in development or activity <br />requested in the application, unless the permittee <br />can obtain a court order permitting the development <br />or engaging in an activity under the provisions of <br />the permit. <br /> <br />I <br />I <br />I <br />I <br /> <br />(6) An action seeking juridical review of the decision <br />of the governing body shall be initiated within <br />sixty (60) days after the decision is made. <br /> <br />1-410 Revocation or Suspension of Permits. <br /> <br />I <br />I <br /> <br />(1) When it comes to the attention of the permit author- <br />ity that the provisions of any permit or the terms <br />of any regulation for administration have been violated <br />by the holder of the permit, the permit authority <br />may temporarily suspend the permit for a period of <br />thirty (30) days. Before making such a temporary <br />suspension, the permit authority shall give the permit <br />holder written notice of the specific violation and <br /> <br />I <br />I <br /> <br />-20- <br />
