1. Dt'nned Terms.
Terms used h these Instructions 10 Bidders which are defined
in the Standard General Conditions of the Construction.Con.
tract. NSPE,ACEC Document 1910-8, CSI 56465 (1978 edi-
tions) have tt.e meanings assigned to them in the General Con~
ditions. The term "Successful Bidder" means the lowest,
qualified, responsible Bidder to whom Owner (on the basis of
Owner's evaluation as hereinafter provided) makes an award.

2. Copits 0 r Bidding Documents.

2.1. Complele sets of the Bidding Documents in the num.
bel' and for the deposit sum, if any, stated in the Advertise.
men! or Invitation may be obtained from Engineer (unless
another issdng office is designated in the Advertisement or
Invitation t'J Bid).

2.2. Complele sets of Bidding Documents shall be used in
preparing Bids; neither Owner nor Engineer assume any re.
sponsibility for errors or misinterpretations resulting from
the use of incomplete sets of Bidding Documents.

2.3. Owner and Engineer in making copies of Bidding
Documents available on the above' terms do so only for the
purpose of obtaining Bids on the Work and do not confer a
license or grant for any other use.

3. Qualifications of Bidders.

To demonstn.te qualifications to perform the Work, each
Bidder must be prepared to submit within five days of Own.
er's request written evidence.of the types set forth in the Sup-
plementary CJnditions, such as financial data. previous expe-
rience and evidence of authority to conduct business in the
jurisdiction where the Project is located. Each Bid must con-
tain evidence of Bidder's qualification to do business in the
state where t~.e Project is located 01' covenant to obtain such
qualification prior to award of the contract.

4. E:uminalion of Contract Documents and Site.

4.1. Before submitting a Bid, eal:h Bidder must (a) exam.
ine the Contract Documents thoroughly. (b) visit the site to
familiarize himself with local conditions that may in any
manner affect cost, progress or p(~rformance of the Work,
(c) familiarize himself with federal. state and local laws,
ordinances, rules and regulalions that may in any manner
affect cost. progress or performance of the Work; and (d)
study and carefully correlate Bidde'r's observations with the
Contract Do:uments.
4.2. Reference is made to the Supplementary Conditions
for the idenlification of those reports of investigations and
tests of subsurface and latent physical conditions at the site
or otherwise affecting cost, progress or performance of the
Work which have been relied upon by Engineer in preparing
the Drawings and Specifications. Owner will make copies of
such reports available to any Biddc~r requesting them. These
reports are not guaranteed as to accuracy or completeness,
nor are they part of the Contract Documents. Before sub~
mitling his Bid each Bidder will, at his own expense. make
such additional investigations and tests as the Bidder may
deem necessary to determine his Bid for performance of the
Work in accordance with the time. price and other terms and
conditions 0: the Contract Documents.

4.3. On request Owner will provide each Bidder access to
the site to ,;onduct such investigations and tests as each Bid-
der deerr:s necessary for submission of his Bid.
4.4. The lands upon which the Work is 10 be performed.

in the Supplementary Conditions. General Requirements or

4.5. The submission of a Bid will constitute an incontro~
vertiblr. representation by the Bidder th<:lt he has complied
with every requirement of this Artkle 4 and thaI the
Contract Documents are sufficient in s<:ope and detail [0
indical(~ ,and convey understanding of all terms and condi-
lions for performance of the Work.
5. IntE'l'pretations.
AU que,stions about the meaning or int'~nt of the Contract
Docum(~nts ~,hall be submitted to Engineer in writing. Replies
will be issued by Addenda mailed or detiv':red 10 all parties re-
corded by Engineer as having received the Bidding Docu-
ments. Ques~:ions received less than ten days prior to Ihe date
for opening of Bids will not be answered, Only questions an-
swered by formal written Addenda will be binding. Oral and
other interpretations or clarifications will be without legal
effect.

6.1. Bid Security shall be made payabl,e to Owner, in a
amount of five percent of the Bidder's maximum Bid p e
and in the form of a certified or bank check or a Bi ond
(on form attached, if a form is prescribed) issued b); Surety

Conditions.

6.2 The Bid Security of the SUl:cessful ldder will be re-
