<br /> <br />WHEREAS, said new report dated January 1986 includes detailed and approximate <br />floodplain information for the City of Rifle that supersedes previously published Flood Insurance <br />Rate Map dated September 1982; and <br /> <br />WHEREAS, said new floodplain information dated January 1986 is more accurate and up <br />to date the than the previously published Flood Insurance Rate Map and was designated by the <br />CWCB via floodplain resolution number 245; and <br /> <br />LOCAL REOVEST FOR DESIGNATION <br /> <br />WHEREAS, CWCB staff members met with local officials from the City of Rifle regarding the <br />City's floodplain information and the CWCB designation and approval process for floodplain <br />information; and <br /> <br />WHEREAS, the City concurred with the proposed Board action and transmitted a letter to the <br />CWCB requesting staff review and formal action by the Board; and <br /> <br />C.R.S. AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies ofIocal jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br /> <br />WHEREAS, the detailed 100-year floodplain information for the City of Rifle in said report <br />met all of the requirements listed under the Board's "Rules and Regulations for the Designation and <br />Approval of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1) <br />and was valid during the time when said study was the "effective" regulatory information for Rifle; and <br /> <br />WHEREAS, the CWCB staff recommends that said Flood Insurance Study dated December <br />1982 be acknowledged and rescinded since better and more accurate information has been published in <br />said new Flood Insurance Study dated September 1986; and <br /> <br />WHEREAS, the CWCB recognizes that floodplain resolution number 245 continues to be the <br />most current and effective regulatory floodplain information for the City of Rifle; and <br /> <br />2 <br />
