<br />Section 37-60-106(1)(c), CRS 1973, as amended, specifies <br />that the Colorado Water Conservation Board is to devise and <br />formulate methods, means, and plans for preventing flood <br />damages. In addition, 24-65.1-403(3) (a), CRS 1973, as amended, <br />requires the CWCB to prescribe the standards for and coordinate <br />all floodplain analyses conducted in the state, Finally, <br />37-60-106(1)(c), CRS 1973, as amended, provides that floodplain <br />designations must first be reviewed and approved by the Board <br />before they can be used by local units of government. Such <br />approval designations are required before local governments can <br />exercise their zoning powers, which zoning in turn is required in <br />order to qualify a community for federally subsidized flood <br />insurance. <br /> <br />Section 37-60-106( 1 )(d), CRS 1973, as amended, and Section <br />24,65.1-302(2)(a), CRS 1973, as amended, direct the CWCB to <br />provide local jurisdictions with the technical assistance and <br />floodplain information needed to make wise land-use decisions and <br />to protect the public health, safety, and welfare. <br /> <br />The August 1, 1977 Executive Order states that directors of <br />state agencies will promote public health, safety, and welfare <br />with regard to the use and development of floodplains. It also <br />specifies that state agencies which implement projects, review <br />and/or partially or fully fund projects by other public or <br />private agencies, or are otherwise involved in land-use or <br />util it ies planning will consider flood hazard in their planning <br />process. The Colorado Water Conservation Board and the Colorado <br />Land Use Commission are the designated agencies which shall <br />provide technical assistance and any other necessary information <br />to help state agencies meet the intent of the Executive Order, <br /> <br />The October 1, 1977 Executive Order supplements the August <br />1, 1977 Executive Order with the provisions that state agencies <br />will meet the requirements of the National Flood Insurance <br />Program for state owned property in .Special Hazard Areas. and <br />will attach any restrictions necessary to meet those requirements <br />when considering the use of or conveyance of state property. In <br />addition, it specifies that state agencies shall consider flood <br />hazards and floodplain management in their actions. Again, the <br />Water Conservation Board and the Land Use Commission are the <br />designated agencies which shall provide assistance in meeting the <br />requirements of the National Flood Insurance Program. <br /> <br />-44- <br />
