<br />would be breached only by the moet severe combination of meteorological <br />and hydrological conditiona which are considered characteristic of the <br />geographics1 region. <br /> <br />I find that the action proposed 'is based upon thorough analysis and <br />evaluation of various practicable alternatives for achieving the <br />stated objectives; that wherever adverse effects are found to be <br />involved they cannot be avoided by following reasonable alternative <br />courses of action which would achieve the specified purposes; that <br />where the proposed action has an adverse effect, this effect is <br />substantially outweighed by other considerations of national policy; <br />that the recommended action is consonant with national policy, <br />statutes, and administrative directives; and that on balance the <br />total public interest should best be served by the implementation <br />of the recommendation. <br /> <br />RECOMMENDATIONS <br /> <br />I recommend that the plan of improvement presented in this report be <br />approved for construction 'under the authority of Section 205 of the <br />1948 Flood Control Act, as amended, and that Federal funds be allotted <br />for construction of the Federal portion of the project providing local <br />interests meet the following requirements for local cooperation: <br /> <br />a. Provide without cost to the United States all lands, easements, <br />rights-of-way, and spoil disposal areas necessary for construction, <br />maintenance, and operation of the project. <br /> <br />b. Bear the cost of all alterations and relocations of utilities, <br />and any other community services that are required for construction of <br />the project. <br /> <br />c. Hold and savs the United States free from damages due to the <br />construction of the project except damages due to fault or negligence <br />of the United States or its contractors. <br /> <br />d. Prevent any encroschment that would prevent or restrict the <br />flow in the existing channels. <br /> <br />e. Prevent any encroachment on the ponding areas that would <br />decrease the capscities. <br /> <br />f. Maintain and operate the project in accordance with ths resu- <br />1stions prescribed by the Secretary of the Army. <br /> <br />g. Assume full responsibility for all projsct costs in excess <br />of the Federsl cost limitation of $2,000,000. <br /> <br />h. At least annually, publicize and notify all interested par- <br />ties that some flooding will continue to occur due to flows greater <br />than design magnitude. <br /> <br />29 <br />
