<br />WHEREAS, a new report entitled " Flood Insurance Study, City of Boulder, a <br />Colorado, Boulder County Volumes 1 and 2," dated May 3, 1990 contains all the floodplain _ <br />information previously presented in the floodplain report entitled "Flood Insurance Study, <br />City of Boulder, Colorado, Boulder County," dated August 4, 1988; and <br /> <br />WHEREAS, said new report includes detailed floodplain information for Boulder <br />Creek, South Boulder Creek, Bear Canyon Creek, Skunk Canyon Creek: Gregory Canyon <br />Creek, Goose Creek, Twomile Creek, Elmer's Twomile Creek, Wonderland Creek, and <br />Fourmile Canyon Creek that is consistent with the floodplain information previously <br />designated by Resolution Nos. 215 on May 5, 1983; 265 on November 18, 1986; 281 on <br />October 1, 1987; and 295, 296, and 297 on May 11, 1989 for the corporate limits of the City <br />of Boulder, Colorado on March 5, 1993; and <br /> <br />WHEREAS, said new report provides approximate floodplain information for Bear <br />Canyon Creek, Bluebell Canyon Creek, King's Gulch, Skunk Creek, Sunshine Canyon Creek <br />and Sunshine Canyon Tributary that is consistent with previously designated detailed <br />information; and <br /> <br />WHEREAS, said new report presents approximate floodplain information for Viele <br />Channel, David's Draw, Anderson Ditch, and Little Dry Creek; and <br /> <br />WHEREAS, the City of Boulder. Colorado has requested the Colorado Water <br />Conservation Board to designate and approve the floodplains set forth in the aforesaid new <br />report; and <br /> <br />e <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the <br />Colorado Water Conservation Board to assist in the prevention of floods and flood damages <br />therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdiction5 may provide zoning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only after designation and <br />approval by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37 -60-106( 1)( c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels <br />or basins and to make such designations available to legislative bodies of local jurisdictions; <br />and <br /> <br />WHEREAS, the information in said new report relating to the subject streams within <br />the corporate limits of the City of Boulder, Colorado meets all of the requirements for <br />detailed and approximate floodplain information listed under the Board's "Rules and <br />Regulations for the Designation and Approval of Floodplain and of Storm or Floodwater <br />Runoff Channels in Colorado" (2 CCR 408-1); <br /> <br />2 <br /> <br />e <br />
