WHEREAS. a' floodplain information report entitled "Flood
Hazard Identification Report. Oak Creek., Oak, Creek, Colorado,"
dated September, 1986., has been prepared by the Colorado Water
Conservation Board at the request of the Town of Oak Creek;
and

HHEREAS, said report describes and outlines the floodplain
data and information for the storm and floodwater runoff
channels or basins of Oak Creek within the Town of Oak Creek
and adjacent areas of unincorporated Routt County; and

WHEREAS, the Town of Oak Creek has requested the Colorado
Water Conservation Board to designate and approve the
floodplain areas as set forth in the aforesaid repor~;, and

WHEREAS, Section 37-60-106(1) (c). Colorado Revised
Statutes, requires the Colorado Water Conservation Board to
assist in the prevention of floods and flood damages therefrom;
and

WHEREAS. Sections 31-23-301 and 30-28-111, Colorado Revised
Statutes. provide that such legislative bodies of local
juriSdictions inay provide zoning regulationsf()r land uses on
or: along any storm or floodwater runoff channel" or' 'basin only
after designation and approval by the Colorado Water
Conservation Board; and

WHEREAS. Section 37-60-106(1)(c), Colorado Revised
Statutes. directs the Colorado Water Conservation Board to
designate and approve storm or floodwater runoff channels or
basins and to make such designations available, to legiSlative
bodies of local juriSdictions; and

WHEREAS. the staff of the Board has reviewed said report
and does hereby recommend to the Colorado Water ,Conservation
Board that the Board designate and approve as floodplain areas
those areas inundated by a 100-year ,flood (intermediate
regionai flood) as described by the floodwater surface
elevations and profiles in said report;
