<br />13. "Surface coal mining operation" means a person or entity <br /> <br /> <br />engaged in surface coal mining operations as defined in <br /> <br /> <br />section 38-14.1-02 of the North Dakota Century Code. <br /> <br />B14. <br /> <br />1415. <br /> <br />1516. <br /> <br />"Temporary wetland" means a shallow depressional <br /> <br /> <br />area which holds water or is water-logged from <br /> <br /> <br />spring runoff until early June. In years of normal <br /> <br /> <br />runoff and precipitation, temporary wetland areas <br /> <br /> <br />may be tilled for crop production. In years of high <br /> <br /> <br />runoff or heavy spring rain, these areas may not <br /> <br /> <br />dry out until mid-July and would not be tilled, but <br /> <br /> <br />may be used for hayland or pasture. Temporary <br /> <br /> <br />wetlands frequently reflood during heavy summer and <br /> <br /> <br />fall rains. Sheetwater as defined in North Dakota <br /> <br /> <br />Century Code section 61-32-02 is not a temporary <br /> <br /> <br />wetland. This definition is the uniform <br /> <br /> <br />classification adopted by the state engineer and <br /> <br /> <br />the game and fish commissioner for "temporary <br /> <br /> <br />wetlands." <br /> <br />"Watercourse" is as defined by section 61-01-06 of <br />the North Dakota Century Code. <br /> <br />"Watershed" is the area draining into a wetland or <br /> <br />series of wetlands. A series of wetlands is a <br /> <br />group <br /> <br />of <br /> <br />more <br /> <br />two <br /> <br />wetlands <br /> <br />which <br /> <br />or <br /> <br />are <br /> <br />-4- <br />
