<br />2. The United states bureau of reclamation for drainage <br />which is a part of the originally authorized Garrison <br />diversion unit authorized in 1965. <br /> <br />3. The North Dakota highway department for federal aid <br />projects. <br /> <br />However, these agencies shall notify the state engineer of <br />any proposed drainage projects during the planning stages <br /> <br />History: <br />General Authority: NDCC 28-32-02, 61-03-13, 61-32-04 <br />Law Implemented: NDCC 61-32-03 <br /> <br />89-02-02-06. Determination of watershed area. Seven and <br />one-half minute topographic maps shall be used by the state <br />engineer to determine the area of a watershed for a wetland, or <br />series of wetlands. This information may be supplemented by <br />aerial photos or a survey conducted under the supervision of a <br />registered land surveyor. An onsite investigation may be <br />conducted by the state engineer if, in his judgment, it is deemed <br />necessary. <br /> <br />History: <br />General Authority: NDCC 28-32-02, <br />Law Implemented: NDCC 61-32-03 <br /> <br />61-03-13, 61-32-04 <br /> <br />89-02-02-07. Applications. <br />drain shall be filed with the <br />engineer's application form. The <br />following: <br /> <br />Applications for a permit to <br />state engineer on the state <br />application shall provide the <br /> <br />1. Description of the drain. <br /> <br />2. United States department of agriculture soil <br />conservation service photos of the project area with <br />the wetlands which are not to be drained specifically <br />identified thereon. <br /> <br />3. An estimate of the number of wetland acres to be <br />drained. <br /> <br />The application may be mailed or delivered to: <br /> <br />Office of the State Engineer <br />900 East Boulevard <br />Bismarck, ND 58505 <br /> <br />Insufficient or incomplete applications will be returned to <br />the applicant by the state engineer. <br /> <br />-5- <br />
