"Watercourse" is as defined by section 61-01-06 of the <br />North Dakota Century Code. <br /> <br />15. "Watershed" is the area draining into a wetland or <br />series of wetlands. Circumstances requiring a drainage permit. <br />Pursuant to this chapter, a permit is required before any person <br />may drain waters from a wetland, or series thereof, with a <br />watershed of eighty acres [32.37 hectares] or more. <br /> <br />For purposes of this section the term "drain" means any <br />process used to decrease the water surface area of a wetland. Area covered by permit. Each wetland in the <br />area identified in the permi t will be permi tted unless <br />specifically identified as being undrained in the permit <br />application. In <br />the event replacement of wetland acre loss is required by federal <br />law the following agencies are deemed by the state engineer <br />capable of providing supervision and analyzing downstream impacts <br />and are exempt from obtaining a permit: <br /> <br />1.
