<br />designated by Resolution No. 120 dated November I, 1978, based on updated hydraulic _ <br />information, relating to the reach of McCabe Creek from its confluence with the San Juan ... <br />River upstream for a distance of 520 feet; and <br /> <br />WHEREAS, said new report provides detailed information that is more accurate and <br />current than the information contained in that portion of the floodplain report. previously <br />designated by Resolution No. 120 dated November I, 1978, based on updated topographic <br />and hydraulic information relating to West McCabe Creek; and <br /> <br />WHEREAS, the Town of Pagosa Springs, Colorado has requested the Colorado Water <br />Conservation Board to designate and approve the floodplains set forth in the aforesaid new <br />report; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the <br />Colorado Water Conservation Board to assist in the prevention of floods and flood damages <br />therefrom; and <br /> <br />WHEREAS, Sections 31-23-301.and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions IIlay provide zoning regulations for land uses on <br />or along any storm or flooowater runoff channel or basin only after designation and <br />approval by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado _ <br />Water Conservation Board to designate and approve storm or floodwater runoff channels' ... <br />or basins and to make such designations available to legislative bodies of local jurisdictions; <br />and <br /> <br />WHEREAS, the information in said new report relating to the reach of the West Fork <br />of McCabe Creek upstream of its confluence with McCabe Creek and the information in <br />said new report relating to McCabe Creek from its confluence with the San Juan River <br />upstream for 520 feet meets all of the requirements for detailed floodplain information <br />listed under the Board's "Rules and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater RUJ10ff Channels in Colorado" (2 CCR 408-1); and <br /> <br />NOW, lHEREFORE, BE IT RESOLVED by the Colorado Water Conservation <br />Board in regular meeting assembled in Cortez, Colorado, this 10th day of July, 1992, that <br />it does hereby designate and approve as detailed floodplain information the 100-year <br />floodplains as described by the floodwater surface elevations and profiles in said new report, <br />dated May 2, 1991 for the study reach of McCabe Creek upstream of its confluence with the <br />San Juan River for a distance of 520 feet an.d for the study reach of West McCabe Creek <br />and does hereby rescind those portions of Resolution No. 120, dated November I, 1978, <br />regarding the study reach of West Fork McCabe Creek and that portion of McCabe Creek <br />from its confluence with the San Juan River upstream for a distance of 520 feet as presented <br />in the May 1991 report; and <br /> <br />e <br /> <br />2 <br />
