<br />e <br /> <br />e <br /> <br />e <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colondo Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only after designation and <br />approval by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1 )( c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation to designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said new report relating to the Colorado River and <br />Horizon Drive Channel meets all of the requirements for detailed information listed under <br />the Board's "Rules and Regulations for the Designation and Approval of Floodplains and <br />of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation <br />Board in regular meeting assembled in Grand Junction, Colorado, this 15th day of <br />September, 1992, that it does hereby designate and approve as detailed floodplain <br />information the 100-year floodplains as described by the floodwater surface elevations and <br />profiles in said new report, dated July 15, 1992, for the study reaches of the Colorado River <br />and Horizon Drive Channel and does hereby rescind those portions of Resolution No. 79, <br />dated September 23, 1977 regarding the Colorado River and Horizon Drive Channel within <br />the corporate limits of the City of Grand Junction on July 15, 1992, as presented in the <br />November 1976 report, and those portions of Resolution No. 208, dated January 6, 1983, <br />regarding the Colorado River and Horizon Drive Channel, as presented in the July 6, 1982 <br />report; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send <br />a certified copy of this resolution to the Board of County Commissioners of Mesa County; <br />the City of Grand Junction; the Colorado Office of Emergency Management; the U.S. Army <br />Corps of Engineers, Sacramento District; and the Federal Emergency Management Agency. <br /> <br />CERTIFICATE <br /> <br />I certify that the foregoing is a true and correct copy of a resolution adopted by a <br />majority vote of the members of the Colorado Water Conservation Board in regular session <br />assembled at Grand Junction, Colorado, on the 15th day of September, 1992, at which a <br />quorum was present. <br /> <br />~'fu!14ry <br /> <br />3 <br />
