<br />559.1 <br /> <br />. <br /> <br />flood damage to real estate or im- <br />proved real property, water and sani- <br />tary facilities, structures and their <br />contents. <br />Flood-related erosion means the col- <br />lapse or subsidence of land along the <br />shore of a lake or other body of water <br />as a result of undermining caused by <br />waves or currents of water exceeding <br />anticipated cyclical levels or suddenly <br />caused by an unusually high water <br />level in a natural body of water, ac- <br />companied by a severe storm, or by an <br />unanticipated force of nature, such as a <br />flash flood or an abnormal tidal surge, <br />or by some ,,;mila.rly unusual and un- <br />foreseeable event which results in <br />flooding. <br />Flood-related erosion area or /lood-re- <br />lated erosion PTone area means a land <br />area adjoining the shore of a lake or <br />other body of water, which due to the . <br />composition of the shoreline or bank <br />and high water levels or wind-driven <br />currents, is likely to suffer flood-relat- <br />ed erosion namR.g'e. <br />Flooli-related erosion aTea management <br />means the operation of an overall pro- <br />gram of corrective and preventive <br />measures for reducing flood-related <br />erosion cl"-mo,ge, including but not lim- <br />ited to emergency preparedness plans, <br />flood-related erosion control works, <br />and flood plain man<<gement regula- <br />tions. <br />FloolilDClY- see regulatory /looaway. <br />FloolilDClY encroachment lines mean the <br />lines marking the limits of floodways <br />on Federal, State and local flood plain <br />maps. <br />Freeboarli means a factor of safety <br />usually expressed in feet above a flood <br />level for purposes of flood plain man- <br />agement. "Freeboard" tends to com- <br />pensate for the many unknown factors <br />that could contribute to flood heights <br />greater than the height calculated for <br />a selected size flood and floodway con- <br />ditions, such as wave action, bridge <br />openingS, and the hydrological effect of <br />urbanization of the watershed. <br />Functionally dependent use means a <br />use which cannot perform its intended <br />purpose unless it is located or carried <br />out in close proXimity to water. The <br />term includes ouly dOCking facilities, <br />port facilities that are necessary for <br />the loading and unloading of cargo or <br />passengers, and ship building and ship <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />" ~ <br /> <br />44 CFR Ch.1 (10+-97 Edition) <br /> <br />repair facilities, but does not include <br />long-term storage or related manufac- <br />turing facilities. <br />General Counsel means the General <br />Counsel of the Federal Emergency <br />Management Agency. <br />Highest adjacent {/To.Q.e means the <br />highest natural elevation of the ground <br />surface prior to construction next to <br />the proposed walls of a structure. <br />Historic Structure means any struc- <br />ture that is: <br />(a) Listed individually in the Na- <br />tional Register of Historic Places (a <br />listing maintained by the Department <br />of Interior) or preJ;m;n"-YilY deter- <br />mined by the Secretary of the Interior <br />as meeting the requirements for indi- <br />vidual listing on the National Register; <br />(b) Certified or preliminarily deter- <br />mined by the Secretary of the Interior <br />as contributing to the historical sig- <br />nificance of a registered historic dis- <br />trict or a district preliminarily deter- <br />mined by the Secretary to qualifY as a <br />registered historic district; <br />(c) Individually listed on a state in- <br />ventory of historic places in states <br />with historic preservation programs <br />which have been approved by the Sec- <br />retary of the Interior; or <br />(d) Individually listed on a local in- <br />ventory of historic places in commu- <br />nities with historic preservation pro- <br />grams that have been certified either: <br />(1) By an approved state program as <br />determined by the Secretary of the In- <br />terior or <br />(2) Directly by the Secretary of the <br />Interior in states without approved <br />programs. " <br />Independent scientific boliy means a <br />non-federal technical or scientific or- <br />ganization involved in the study of <br />land use pl,,-nn;ng, flood plain l""-nl\ge- <br />ment, hydrology, geology, geography, <br />or any other related field of study con- <br />cerned with flooding. <br />Insurance a4justment organization <br />means any organization or person en- <br />gaged in the business of adjusting loss <br />claims arising under the Standard <br />Flood Insurance Policy. <br />Insurance company or insurer means <br />any person or organization authorized <br />to engage in the insurance business <br />under the laws of any State. <br /> <br />....
